Kidnap suspect is a ‘terror,’ judge says

Justin Shine injected his 6-year-old neighbor with cocaine to disable and rape her, the prosecutor said.

Police found ropes and chains in a pile of sexual bondage material in the apartment where the girl had been held, said Hanover police officer David Zemotel, one of the officers who took Shine into custody after a bloody fight.

Shine’s court-appointed attorney argued the whole thing was “a one time aberration that probably will not happen again,” and asked the Shine, 26, be released on bail.

Judge Ronald Moynahan was having none of that. He called Shine “a terror to the community” and ordered him held without bail Wednesday after a hearing.

“This man wreaks terror on housing developments and reeks terror on little 6-year-old girls,” Moynahan said.

Jessica Shine, the 20-year-old sister of Justin Shine, called the Ledger newsroom later in the day. She said she used to look up to her big brother.

A childhood accident that left Justin Shine with a shattered knee cap changed the course of his life, she said, providing him with an endless stream of painkiller prescriptions that led to a more dangerous drug habit.

The drugs exacerbated Justin Shine’s struggle with depression and bipolar disorder, Jessica Shine said, changing the person she had grown up with.

Justin Shine now stands accused of kidnapping and drugging the 6-year-old neighbor, who police say he lured into his ex-girlfriend’s Hanover apartment by asking if she wanted to see pet gerbils.

In Hingham District Court, prosecutors described Justin Shine Wednesday as a dangerous criminal who injected the young girl with a hypodermic needle of cocaine, shackled her ankles and taped her wrists and mouth.

It was a scenario his sister said the family could never associate with Justin Shine, who is the father of two young children.

“I don’t think he was in his right mind,” Jessica Shine said. “I know he did an absolutely horrible thing, and I’m not defending him, but it wasn’t him. He wasn’t there mentally.”

Assistant Plymouth County District Attorney Sharon Donatelle called the girl’s abduction a “deliberate, premeditated act” and asked he remain in jail pending trial.

“Clearly, the defendant had, I suggest, an evil intent to disable her,” she said. “His choice of weapon in this case was a loaded syringe, a syringe that could have certainly disabled her.”

The drug was found in the girl’s urine at South Shore Hospital in Weymouth shortly after her ordeal, Donatelle said.

Justin Shine’s attorney, William Leonard, argued that he should be entitled to bail because his alleged acts are unlikely to be repeated.

“He’s gone through a lot in the last couple of days, and I’m sure it’s knocked some sense into him,” Leonard said. “If he is released, I’m sure he will not be a threat to anybody.”

Donatelle described the scene after police found the little girl, who had been reported missing 30 minutes earlier by her mother.

Justin Shine lured her into his apartment and later confessed to police that he planned to engage in “sexual activity” with the girl, Donatelle said.

Hanover police swarmed the complex Saturday afternoon, banging on apartment doors and yelling her name. Justin Shine made the girl stay in a bathroom for about 30 minutes but cut the tape from her wrists when police began knocking on doors, Donatelle said.

The girl removed the tape from her mouth, and Justin Shine brought her to the apartment’s rear door and let her go, still wearing the shackles, Donatelle said.

Police found Justin Shine, who had cut his left wrist with a knife, covered with blood in the bathroom. Zemotel, the Hanover patrol officer, struck him on the head with his gun, knocking him to the ground when Justin Shine lunged at him and two other officers. He continued to struggle until he was handcuffed.

Zemotel said officers found a pile of sexual bondage material in the three-bedroom apartment, including the ropes, chains and a sex toy.

Justin Shine could be sentenced up to 15 years in prison if convicted on the kidnapping charge, and Donatelle said there is probable cause to file additional charges of drugging the girl to kidnap her, drugging her to have sexual intercourse, assault and battery with a hypodermic needle and aggravated assault and battery with a dangerous weapon on a child. Those charges, upon conviction, could carry additional long sentences.

Jessica Shine said she hasn’t seen or spoken to her brother since he was arrested but hopes that he will get the help he deserves.

“I just hope he pleads insanity and goes to an institution,” Jessica Shine said.
