Gatlinburg, TNA woman was jogging near her home in Atlanta Tuesday morning, when an acquaintance pulled up behind and asked her to check out his new car. When the woman took a seat in the car, the acquaintance, David Jansen, immediately tied her up. Then, he took his captive on a little road trip…200 miles away, to a rented cabin in Tennessee. There, she was tied to a couch and raped.

Kidnapping and raping sure can make a dude hungry…so, what does he do? Dumb shit ordered a pizza. Enter 32-year-old Chris Turner, pizza guy extraordinaire. The cabin was a bit off his usual route, about 30 miles up into the hills, but he set off to make the delivery anyway. While he’s standing at the door waiting for Jansen to sign the credit card slip, something in the cabin caught his eye. It was a woman. “While I was standing in the door all you could see was the back of the couch,” Turner said. “And then she popped over the back of the couch and showed me that her hands were bound. And she was just mouthing, ‘Please call 911.’” Turner didn’t know what to make of the situation, he mouthed back, “Are you serious?” At which point the bound woman rolled her eyes and fell back onto the couch. When the pizza transaction was finished, the bill totaling $37.69 and a tip of $5, Turner beat feet back to his delivery van where his wife was waiting behind the wheel. “Go, go go!” he ordered, while trying to explain what he had just witnessed. They made it to a home nearby and called 911.

Police arrived and confronted 46-year-old David Jansen. He told officers that he and the victim were on a “romantic getaway from their spouses” and the woman was sexually aroused by bondage. Jansen was taken into custody at the scene and the woman was taken to the hospital to be treated for minor injuries. A search warrant served on the cabin provided evidence that substantiated the victim’s claim. Janses was charged with aggravated kidnapping and rape. Late Thursday, he made bond of $800,000 and was released. The victim and her husband visited Turner before heading home Wednesday. “She was just thanking me … for trusting her,” Turner said. “She said he was going to kill her after he got done with her.”

Update: 7/2/09 - The D.A.’s office has dismissed the rape and kidnapping charges against David Jansen. Though the supposed victim in the case insists that her accusations are true and refuses to recant, her attorney said they “do not intend to pressure the state of Tennessee to proceed.” To you, Mr. Jansen, I apologize and wish you nothing but the best. -Jaded

His bond was just $800,000?!?  Good Lord!  Generally, the defendant only has to come up with 10% of the bond in order to bond out.  If that’s the case here, he would only have had to come up with 80K.  But this is a very serious crime, with a victim/witness who is vulnerable.   It’s very disturbing that this POS is out among us.

Oh, and the $5 tip for the pizza deliveryman?  What a cheapskate (in addition to being a shitball rapist)!  That $5 wouldn’t even cover the deliveryman’s gas on a 60 mile round trip.

Thank God for that deliveryman.  I can’t help but feel there was a little “divine intervention” in all this.

Kudos to Chris Turner for acting decisively when he perceived something was wrong, but has anyone thought about how odd all of this was? He says it was pre-planned, she says he happened across her while jogging. I jog a lot and it would be hard for anyone, even my spouse, to easily find me since most runners change routes depending on the type run planned. Secondly, I (and most runners) would likely finish my routine before ending it to examine a close friend or relative’s “new” vehicle during an outing, much less a business associate from her hubby’s bar. Third, she told Chris that “they” had the cabin rented until Saturday. How could she know that? And why was he so nonchalant about leaving the door wide open for Chris to see the sofa and why wasn’t she gagged? Last and most important, WTF didn’t she start screaming as soon as the door opened, if in reality she was bound against her will and being raped and knew she was to die “after he got done with her”? I am betting a lot more will come out, like if she’s a stripper or escort will that change opinions?  Thinking presumption of innocence may be a safer route on this one until the trial ends.

He says it was pre-planned, she says he happened across her while jogging. I jog a lot and it would be hard for anyone, even my spouse, to easily find me since most runners change routes depending on the type run planned.

Odd, yes…but that’s because David Jansen is a creepy, kidnapping rapist, not because he happened across someone he knew while she was jogging.  Maybe she wasn’t a route-changing type of jogger…or maybe it was an unplanned encounter with an aquaintance, since, you know, things like that never happen.

Secondly, I (and most runners) would likely finish my routine before ending it to examine a close friend or relative’s “new” vehicle during an outing, much less a business associate from her hubby’s bar.

I don’t find it odd that she didn’t tell him, while jogging in place, “Let me finish my jog first.  I’ll check out your new car some other time…even though you have it right in front of me right now.”  If she did, I think that would be odd.

Third, she told Chris that “they” had the cabin rented until Saturday. How could she know that?

Those were Chris’ words, not the victim’s.  Even so, perhaps creepy, kidnapping rapist told her that “they” had the cabin until Saturday.  Again, not odd in my book.

And why was he so nonchalant about leaving the door wide open for Chris to see the sofa and why wasn’t she gagged?

Maybe because he’s a stupid, creepy, kidnapping rapist, and maybe he wanted her mouth available for oral.

Last and most important, WTF didn’t she start screaming as soon as the door opened, if in reality she was bound against her will and being raped and knew she was to die “after he got done with her”?

Maybe she was afraid that if she started screaming the stupid, creepy, kidnapping rapist would kill her and the pizza guy right then and there and she would have no chance for survival.

I am betting a lot more will come out, like if she’s a stripper or escort will that change opinions?

Because strippers and/or escorts ask for 911 to be called when they’re willing participants in a fun little game of S&M?  That would be odd.

Thinking presumption of innocence may be a safer route on this one until the trial ends.

    Really?  That’s odd.

(OK, let’s see how my quoting skillz panned out.)
Edit: DAMMIT…can someone fix that for me and give me a refresher course?

You are spot on regarding ALL points, prettyu. It was all pre-planned and contingent on everything going perfectly, down to to the last detail, almost with the precision of a watch maker, EXCEPT, when he did the “stupid” stuff and then he was a simply a moron. Yep, makes perfect sense to me. Let’s just throw away the 8th Article from the Bill of Rights, our Constitution and the Presumption of Innocence in this case since it’s so clearly cut and dried, huh?

Betting the idea of a presumption of innocence wasn’t just meant for the jury, but for all of society, including the media, Ronnie. Why not simply adopt the presumption of guilt? Most here would prolly vote for it, we could save a bunch of money on trials because many would cop a plea and the possible victims wouldn’t suffer the glare from being in the kliegs all the time. That is, of course, unless you or yours might be the one being presumed guilty.

  23. tutkill
    6:48 pm on May 31st, 2009

Another common misunderstanding which leads to the assumption that the presumption of innocence is not applied in civil law systems might be based on the fact that many jurisdictions allow administrative bodies to fine minor misdemeanors, in particular traffic violations, without prior obtaining a court judgment and sometimes “on the spot.

Another example presumption of justice being questionable-Modern practices aimed at curing social ills may run against presumption of innocence. Some civil rights activists feel that pre-employment drug testing, while legal, violates this principle, as potential employees are presumed to be users of illegal drugs, and must prove themselves innocent through the test.

another example not quite working-In Europe and the Americas, until the French Revolution, it was common for the justice system to have suspects tortured to extract confessions from them. Even though the suspects had not yet been found legally guilty, they were exposed to considerable pain, often with lasting physical consequences

one more example-In some systems, suspects may be detained for long periods while inquiries proceed. Such long imprisonment constitutes, in practice, a hardship and a punishment for the suspect, even though he or she has not yet been sentenced.

There are many other examples where the presumption of innocence fails or does not work. However,  since this site is not about the presumption of innocence (LOL)  you may resume throwing stones.

Sad story.  But, my favorite part is when  So Jaded writes that the woman showed herself to the pizza guy and he responds “are you serious” then she “rolls her eyes and sits back on the couch.”    I mean the situation is not funny, but that part really is.

  33. 39andHolding
    10:35 am on June 1st, 2009

I am not saying she went willingly, Nadine, the accused said that. As far as him killing her when done, that seems absurd, unless he wanted to get caught. What was he going to do with the body? He’s halfway up a mountain, in a rented car, not a van, and he has some major health problems and is on meds, according to some accounts. My point is only that there has been a lot of info revealed, and likely much, much more to come out at trial. Before we draw & quarter him, let’s at least hear the rest of the evidence…from both sides. Whatcha say?

39andHolding – If she was complicit, why do you think she made the effort to get the delivery man’s attention, suggesting she was in trouble?

Also, where have you read that she had a change of clothes and toiletries at the cabin?

  39. 39andHolding
    12:45 pm on June 1st, 2009

Read he cut off all her clothes prior to starting the frivolities, Athena, which means she had to have something else to wear for the interview, unless she went downtown in the buff. Also saw that they used condoms, and it’s hard to think he was gonna rape and murder her, but first make sure he didn’t get her preggers or give her an STD. As for getting the delivery man’s attention, why wait to “popped over the back of the couch” and mouth the words that got him wondering? She would have literally jumped up and yelled Bloody Murder had she really figured her life was in much danger as her cervix. Still, this is mostly speculation, isn’t it?

Right, I’m “simple” for taking the exact same position that nearly everyone on DD has taken at one time or another.

Here’s a tip, biteme — when your ad hominem attacks are this much of a stretch, you look pathetic.  Also, I noticed that you never acknowledged your claims about the pharmacist murder case were totally off the mark ; instead you went with the personal, ad hominem attack approach on that one as well, laced with more of your racial obsession.  Classy.

Read he cut off all her clothes prior to starting the frivolities, Athena, which means she had to have something else to wear for the interview, unless she went downtown in the buff.

Or the police provided something to clothe her with, which is standard procedure when a victim is found naked. They don’t just pop them into the back of the cruiser like that.

Also saw that they used condoms, and it’s hard to think he was gonna rape and murder her, but first make sure he didn’t get her preggers or give her an STD.

Likely, he was more concerned about getting and STD and/or leaving DNA evidence. Rapists and murders often use protection.

As for getting the delivery man’s attention, why wait to “popped over the back of the couch” and mouth the words that got him wondering? She would have literally jumped up and yelled Bloody Murder had she really figured her life was in much danger as her cervix.

Because, had she done what you described, she would have put herself and the delivery man in danger, forcing her captor to react, most likely violently. This is why, in kidnap situations, the victim typically tries to use quiet means to alarm people as to their situation. Even if they are out in public, where a victim could probably hop in the arms of the biggest man and the room and be safe, they often opt to leave a note on a napkin or silently signal to someone that they’re in trouble.

Speculation, indeed. I appreciate the scrutiny you’re applying to the details of this case. I’m just scrutinizing your scrutiny. :)

You know, if you’re just speculating here, I have to wonder about your language.  Frivolities?  What?  You’ve already determined this whole thing was a frivolous, fun romp?   Considering that, your “Hey, I’m just speculating” claims seem a little disingenuous.  And your cervix comment is just plain bizarre.  I can’t even begin to imagine what that was supposed to mean.

You say you’re just speculating, but you’ve made some assumptions that are a big stretch.  The fact that she must have been clothed for the police interview means that these clothes had to have been her own that she brought with her?  That’s what you deem suspicious?  And it never occurred to you that maybe this asshole was worried about getting an STD himself?  You just assume that the condom equals his concern for her well-being?  What?

I actually quite like what Veronica has to say and Athena for that matter.  It sounds to me like 39andholding has some ties to this case and is just trying to stand up for this guy.  He/she knows the wife or something.  Regardless David Jansen is a dangerous guy and I am thankful that woman was able to get away….stripper or not, because we all know strippers shouldn’t have as many rights as the rest of us.  It is ok to kidnap them and possibly kill them.  Why do they keep asking for it, damn them strippers.

Come on Cassie, you know we only kidnap and kill the ho’s, right? We just kill the Craig’s List babes and simply kidnap the strippers. Get it straight, woman!

BTW, said I knew the wife, never met the hubby, but if he is found not guilty may tag along on the next Smokies excursion. Wanna come?
