The state attorney’s office is appealing a suspended sentence handed down in November against Jennifer D’Silva.

D’Silva, a Fort Walton Beach woman charged with leaving an infant strapped in a car seat alone overnight, received a two-year prison sentence that was suspended by Okaloosa County Circuit Judge Thomas Remington.

She had pleaded no contest to charges of child abuse and violation of probation.

Christine Bosau, the prosecutor in the case, said the appeal is based on the state attorney’s office belief that Remington did not have the authority to rule the way he did.

“We felt it was an abuse of the court’s discretion,” she said.

Bosau had asked Remington to sentence D’Silva to 10 years in prison. At a Nov. 9 sentencing hearing, she sought maximum, consecutive sentences for the two charges.

David Thomas, D’Silva’s attorney, said he was “disappointed” by the state attorney’s office’s decision to appeal.

“Judge Remington was fully aware of the circumstances surrounding this case,” he said. “That was the most complete pre-sentencing report I’ve ever seen.”

He said D’Silva is seeking a college degree and hopes to start a new life.

Red flags went up about D’Silva’s possible travels when she posted on her MySpace that she’d been to Texas, according to Gretl Plessinger, a spokeswoman for the Florida Department of Corrections.

Even so, she recently obtained permission to go to Pinellas County.

But lawmen in the Tampa area called Okaloosa County probation officers about 20 minutes after D’Silva received permission to make the approximately five-hour drive to say she already was there, Plessinger said.
