James S. Harris Got His Ass Whooped!

KANSAS CITY, Mo.-Crime does not pay. Sometimes, asswipes like James S. Harris, 18, need a little extra help in remembering that statement. I hope this last incident serves as a life-long reminder for him if  he ever gets invited to another party. Hopefully, the next time, he’ll also remember to leave his knife at home.


Around 2:00 on the morning of Feb. 22, 2009 police officers responded to a 911 call on the 1800 block of Gates Drive in Platte City. At the scene they found a woman in the back seat of a car bleeding from multiple stab wounds and a man who had been stabbed in the hand.

They found Harris lying face down on a sidewalk in front of the house. This sentence alone had me laughing.

The man stated they were having a party at the home when James S. Harris was accused of stealing an Xbox video game system. I’m assuming Harris denied the accusations, because the woman kept at him and when she didn’t relent, Harris pulled out a knife.

What kind of moron pulls a knife on an unarmed woman who’s calling him a thief? James Harris, you are a complete fucking asshole!

The man immediately stepped between them and that was when he was cut on the hand. He said he was not aware anyone else was hurt until the woman stated she had been stabbed.

I’m guessing this was when the party really got going because several of the other party-goers began giving Harris the much needed ass-whooping he deserved. After they were able to subdue Harris (snicker), they took a look in the shithead’s car. Low and behold, there was the stolen Xbox sitting inside his trunk.

The woman was taken to a hospital where she underwent surgery to repair a puncture to her liver caused by one of the stab wounds. I hope she heals soon and fully recovers.

James S. Harris faces one count of first-degree assault, one count of second-degree assault, two counts of armed criminal action, and stealing. He is being held on $150,000 cash-only bond.

Hopefully, anyone who knows this assturd will find their way to the Dreamin’ Demon and bring along with them any video of Harris’ ass-beating. Just by looking at the mugshot above, which was taken after they subdued him (more snickering), I know that I would definitely enjoy viewing it!

    I agree a video would be good, then identify those on the video who were involved in assault and bring them to justice.

    You should subdue and contain the someone (who in this case has stabbed someone) and inform the police.

    Using this as an excuse to unleash whatever frustration you have in your life and justifying it to yourself and others as justice, is self indulgent and extremely immature.

    Thanks to the man that stepped in between, this is a truly noble person. I hope that the woman makes a speedy & full recovery. As for numbnuts, I hope that you’ve learned your lesson, and are able to walk away with a few broken bones in the face. As for the crowd of “subduers;” wasn’t it strange how he kept running into your fists as he was trying to make his cowardly escape?
    And, to those that want the crowd prosecuted… STFU!

    It does not say anyone saw red and went to work on his ass. THEY TAUGHT HIM LESSON that I hope he learned.

    They did not chase him down, they ended a confrontation. In my state, I am allowed to defend myself OR A THIRD PARTY with lethal means if necessary. And if the perp is wielding a bludgeon, bladed weapon, or firearm, and I believe he intends to do SERIOUS BODILY HARM, I can legally let my 40cal end the ordeal without fear of prosecution. THAT IS THE LAW.

    I’d say he is lucky to be alive. He stabbed TWO PEOPLE before the crowd subdued him (and keep in mind it does not say how big the crowd was). No jury would have convicted any of them for protecting the life of this woman and the man who tried to defend her.

    The lady he stabbed could have died. If they used weapons on him after he no longer had the knife, or continued to beat on him after he was subdued, then you’d have a case.
    By all reports, James was getting stabby and the other guests acted in the best interest of safety.

    There was a case here a few years back in which a guy tried to rob a Taco Bell and the workers jumped the counter and whooped him a good one. They showed the video on the news. They kept hitting him with things even after he was unconcious all the way until the police arrived. It was funny, but it was kinda fucked up.
    The employees did get charged with some sort of exessive use of force charge.

    Until the reports say that that happened in this case, I have no pity for some schmuck that steals from someone who invited hm into their home, and then stabs people when they question him about it. And the people who stopped him just might be heroes in my book..

    Harris introduced deadly force to the situation. Those people acting in self defence and in defence of others could have, legally, on this side of the Atlantic, struck him such a blow as would be lethal in order to neutralise the positive threat he posed to their lives and their health at the time he posed the threat. They could have shot him to neutralise the threat he posed. They could have stabbed him with a bigger knife. They could have struck him with a quarterstaff, a cricket bat, a baseball bat, a folding chair, a tire iron, a nunchaku, or any number of other impact or edged weapons or subdued him through any number of empty-handed martial arts, including those with lethal consequences.

    I count two definite blows: one broke his nose and blackened both eyes; the other dislocated or broke his jaw and knocked him unconscious. The abrasions surrounding his left eye could be the result of a third blow or they could be the result of him hitting the ground face first. So it appears that somebody only used the level of physical force necessary to subdue somebody (Harris) who himself used unjustifiable deadly physical force without themselves using justifiable deadly physical force.

    I applaud that person’s restraint.

    You don’t have much experience with America’s criminal justice system, do you? There’s this little thing called “prosecutorial discretion”, meaning the DA decides which charges to file, if any. You add to that a sympathetic jury, even IF this douchebag had died, I doubt any of his “attackers” would spend a day in jail. They’d get probation, or maybe even sentencing that was suspended entirely. (And I’m talking worst case scenario. I seriously doubt charges would be filed at all.)

    If you’re dumb enough to stab the hosts of A PARTY after they accuse you of stealing, you should expect no less. I attended more than one party like this in my younger days, and if someone fucked up (we had a young man aggressively groping females, at one), they got their ass beat. Cops would come, and just like in this case, after they heard the story, no one but the dipshit got arrested.

    You and your “bollocks” might find it less than civilized, but that’s how society operates, more often than not.

    I looked up Missouri’s laws on this. To quote:
    Use of force in defense of persons.

    563.031. 1. A person may, subject to the provisions of subsection 2 of this section, use physical force upon another person when and to the extent he or she reasonably believes such force to be necessary to defend himself or herself or a third person from what he or she reasonably believes to be the use or imminent use of unlawful force by such other person, unless:

    [snip]

    2. A person may not use deadly force upon another person under the circumstances specified in subsection 1 of this section unless:

    (1) He or she reasonably believes that such deadly force is necessary to protect himself or herself or another against death, serious physical injury, or any forcible felony; or

    [snip]

    To add to the fun, we have this beautiful little jewel:
    Justification as an absolute defense, when.

    563.074. 1. Notwithstanding the provisions of section 563.016, a person who uses force as described in sections 563.031, 563.041, 563.046, 563.051, 563.056, and 563.061 is justified in using such force and such fact shall be an absolute defense to criminal prosecution or civil liability.

    2. The court shall award attorney’s fees, court costs, and all reasonable expenses incurred by the defendant in defense of any civil action brought by a plaintiff if the court finds that the defendant has an absolute defense as provided in subsection 1 of this section.

    There is the law in Missouri, polomint. The partygoers “use[d] physical force upon [Harris] when and to the extent [they] reasonably believe[d] such force to be necessary to defend [themselves] from what [they] reasonably believe[d] to be the use or imminent use of unlawful force by [Harris]“. Harris had no such justification for using physical force, much less deadly force. And since Harris was armed with a knife and had already used it to inflict “serious physical injury” upon two people deadly force would have been explicitly authorized by Missouri statutes if a reasonable person in that situation would believe that deadly force was necessary to prevent him from repeating the serious physical injury on another person.

    Better than that, according to Missouri law if the investigation discloses that nobody put the boot in while he was down he can’t even sue them for opening the can of whupass on him. That’s quoted up there too. And if he is fool enough to do so then he can pay the attorney’s fees for the folks he sued.

    But don’t believe me if you don’t want to. You can look it up for yourself. Laws dealing with justifications for the use of force normally are state-level laws and can be read for a specific state at www dot two-letter mailing abbreviation dot gov. You can find those two-letter abbreviations on Wikipedia. And if the state’s laws are not linked on the state’s home page then they will be linked from the state legislature’s home page.

    The problem with reasonable doubt is it a subjective thing, if you get one jury you end up in prison, get another all you have lost is a shit load of your time defending yourself.

    My point on Excessive force is quotes like

    I do remember reading of various councils that hold that one cannot fence in or lock one’s garden sheds for fear a thief might incur an injury while stealing one’s property from said shed, though, and reading of various prosecutions occurring because somebody acted in self defense. Hence my voiced sorrow for the devolution that has occurred in the land where the nobles compelled their ruler to recognize their right to be armed.

    The problem with reasonable doubt is it a subjective thing, if you get one jury you end up in prison, get another all you have lost is a shit load of your time defending yourself.

    The applicable statute is crystal clear. Physical force is justified under RSMO 563.031.1 and 563.074.1, and if it gets to that point the trial attorney simply needs to move for a directed acquittal under those statutes. No reasonable doubt necessary.

    Actually, they did quite well for untrained civilians. He was armed with a knife and had already used it to cause serious physical injury to two people, as the term is defined in Missouri statutes, so he had already demonstrated a depraved indifference to human life. He was a threat to the safety, if not to the life, of everybody there while he was armed, conscious, and belligerent. At least one person closed with him and, judging by the mug shot, struck him in the nose, breaking it, to cause a flare of distracting pain to drive thoughts of the knife, at least temporarily, out of his head then struck him on the left jaw with sufficient force to at least dislocate his jaw if not actually break it, transmitting enough shock to his brain to cause a concussion and knock him unconscious. Note the depressed nasal bridge and the pronounced curve between the bridge and the tip of the nose, and the lateral displacement of the chin in relation to the remainder of the facial features. The neck of a hospital gown is also visible in the mug shot. A trained person could have subdued Harris without striking him. He would not have lost consciousness nor would his nose been broken or his jaw dislocated, though he still might have suffered broken bones, dislocated joints, or ruptured ligaments.

    While I cannot speak for Flaming Fox I can say that had I put a “snicker” in that spot in that context it would have been in relation to the visible marks of that subdual left upon Harris’s face. Nothing more. Nothing less.

    I am not saying that if I was there, I wouldn’t have joined in, I don’t know I’ve never been in that situation. But I hope that I could control myself and act like a sensible and mature human being and control my primitive urges.

    The partygoers did act like sensible and mature human beings. They captured a violent felon — alive — to stand trial for his felonies. They also controlled their primitive urges because they didn’t take his knife away from him and use it to eviscerate him while he was unconscious.
