Shelby, NC–Kathy Lynn Swafford, 20, and Dwight Stacy Justice, 42, began dating in OctoberOctober reviewsOctober reviews of last year. Before Justice entered the picture, Kathy Lynn had a happy and healthy 2-year-old son, Jeremiah Swafford. Now, 4 months and one wedding later, Kathy Lynn has a dead son.

Medical personnel responded to the home FridayFriday reviewsFriday reviews after a 911 caller said the child had been sick for a couple days. The caller also stated the boy had a knot on his head and had been throwing up blood. Jeremiah was rushed to Cleveland Regional Medical Center for treatment before being airlifted to Carolinas Medical Center. He died SaturdaySaturday reviewsSaturday reviews. Sheriff’s officials say he suffered head trauma and other injuries to his body.

Swafford’s relatives are outraged…they began noticing signs of abuse at about the same time JusticeJustice reviewsJustice reviews and Swafford began dating. Jeremiah’s grandmother, Kathy Jean Swafford, who cared for him from the day he was born until the day he began living with his mother and Justice, noticed frequent black eyes and bruises on his little body. When she asked her daughter about the abuse, Kathy Lynn always had an excuse ready. For the black eye? He’d been at a birthday party and ‘the kids started picking on him and beat him up.’ His swollen face? An allergic reaction to a bee sting.

Cindy Cochran, Jeremiah’s great-aunt, reported that ‘Jeremiah was hit so hard the bruises of the hand was still on his face. They popped out the tube in his ear.’ Kathy Jean took the little boy to the hospital in December when she noticed suspicious bruising. She said Jeremiah was handed back over to his parents, and that’s the last time she saw him. Cindy Cochran feared that if the child wasn’t removed from the home, he wouldn’t see his third birthday. Sadly, she was right.

Jeremiah’s grandmother and great aunt said they contacted the Department of Social Services on several occasions and filed numerous complaints. Nada. Detectives say they conducted a thorough investigation in late December that included the Department of Social Services. DSS would neither confirm nor deny their involvement in Jeremiah’s case. However, records show two abuse complaints were filed, one on December 30 and one on February 13, the day before Jeremiah died. Sounds to me like the family’s cries for help were ignored.

Kathy Lynn Swafford and Dwight Stacy Justice were married just four days before Jeremiah died. They are celebrating their honeymoon in seperate cells. Both are being held without bond in the Cleveland County Detention Center and both face charges of felony murder and felony intentional child abuse causing serious bodily injury. Both have criminal records as well. Kathy Lynn was charged in 2005 and 2006 for misdemeanor simple assault, second-degree trespassing and other offenses. Justice has various drug and traffic related offenses, larceny, and breaking and entering. Fuck ya both….

Now I have no opinion on this either way, not having researched it any, but I’m aware that people (the disgruntled kind,) accuse social services departments across the country of this.

    I just feel they spend a lot of time and money on the wealthy and tend to avoid the poor :-) If publicity is unlikely DCS is invisible

    Now maybe it was all tongue in cheek that I'm failing to pick up on since I missed this conversation when it happened - but were people *seriously* suggesting we empower private companies and offer them a profit motive to remove children from their families and sell them to some other family? Because that's just purely ridiculous on it's face. Some of the most horrific CPS failures we've featured here on DD track back to failures of private service providers contracted by CPS agencies, and theoretically they're still supervised by the government. CPS already gets accused of removing children and placing them with nonrelatives based on the federal dollars it brings to the department. Who really wants to cement a system where removal decisions are so frankly based on how profitable or unprofitable a particular child will be to a private company? You know, I'm just going to chalk that up as a joke and stop shaking my head over it, lol.

    Honestly, I try to keep up, but the economics... well, there's a reason I'm not an accountant. But I am good at human emotion and behavioral psychology. One reason I became a Foster Parent. The human creature facinates me. Why! that is the one question that drives me harder than any other. Why did he do this...Why did they not do that...Why would she leave the baby with him...and so on.
    The sad fact is, I have seen the system from the inside, and I have seen the caseworkers frustrated at having to return the child(ren), knowing full well they would be right back out there the next month to save them again.

    I don't know how other depts are run, but REUNIFICATION is the first primary Treatment Plan for this one. When that fails, then they move to Long-Term Foster or Adoption. But always reunification first. That is what is required by LAW.

    I have also seen caseworkers push the envelope for the parents because they know the parents are really trying to do better, and I have seen the CW do only the bare minimum to help the parent because the CW knows what the outcome is going to be...LONG -Term Foster with hopes for adoption.

    This goes way beyond just paying the bills. It is in the LAWS of our states where we must make changes.

    They're not making money off cheap labor, they're making money, by not paying billions to prison administrators having a scotch at the country club, trying to decide if they should go to Vegas or Hawaii for their next budget meeting. I don't think UPS or the other parcel services are making money instead of loosing money like the post office because of cheap labor. Look I'm not trying to be difficult but you'll have to look up how the deferent states and contracts are dealt with and why it's profitable to both the state and the companies involved, but it's not because of cheap labor, and even if it was why couldn't the state take advantage of the cheap labor instead of being inefficient and losing more money every year, now private companies are profitable on less money.

    Government run Depts have their shortcomings, but I would rather put my faith in a government run childprotection than a private one. I am a foster parent and I have seen the good and the bad. I have seen What happens when they return a child too soon, but the effect on the child from not being returned at all can be devastating to them. There can be no Blanket policies when it comes to child welfare. A parent that screws up and then fixes their life should be allowed to have their children back, with ongoing monitoring.
    Problem is…most agencies are so overwhelmed that they cannot handle the caseloads. Because of my personal circumstances, both of my caseworkers meet at my house for the monthly visitation AFTER THE SHOULD HAVE ALREADY GONE HOME FOR THE DAY. That’s right, they go out of their way to help me because homes that will take teens are few and far between. Most teens get thrown into group homes. Dissociative disorders run rampant in group homes, and thats just a small example.
    Nothing is ever as easy as it would seem. Playing armchair QB is not helpful, it only hurts. There are a lot of good people out there who have dedicated their lives to helping children. Don’t slam them all because there are problems.

    I have never seen an efficient government run agency, no competition, no real expectations, no accountability, keep your nose clean, don't do anything, don't ever admit to anything and you have a lifetime job with multiple promotions, just don't do anything, don't rock the boat and you'll go far=no expectation=no accountability=failure=child services. I'm talking upper management not the poor sole in the field trying to make a deference.
    If the post office had been private it would have been efficient and one of the most profitable businesses in the world, but it was government and run like child services, so now you have UPS and so on private efficient and profitable companies taking over.
    give me private and accountability any day.

    Having been involved with caseworkers for many years now, it is sad to watch the shifts in personalities as the years go by.

    All or most start off believing they can save the world. By the end of the first year, reality has already reared its ugly head and the frustrations with their own dept, with the foster parents, and with the bio-parents have taken their toll. Burn-out is prevalent among caseworkers, and most are lucky to make it 5 years.

    Two complaints a day if I seriously suspect abuse. No SHIT. If I don't see results, I work my way up the ladder until results happen. Sometimes, that's what you have to do. Especially if its someone you love.

    I am certainly not defending all dept's. So many of them need complete overhauls from top to bottom, but who has the money for that. That, however is the advantage of public vs private. If the private loses its funding...whoosh...gone...and now the kids it was monitoring...whoosh...gone.

    Locally, we have yearly conferences between DHS, Foster parents, and state admin. to discuss areas of concern. Happy to say, they listen to us, and though they may not always get the results we hope for, they do get results.

    Government run Depts have their shortcomings, but I would rather put my faith in a government run childprotection than a private one. I am a foster parent and I have seen the good and the bad. I have seen What happens when they return a child too soon, but the effect on the child from not being returned at all can be devastating to them. There can be no Blanket policies when it comes to child welfare. A parent that screws up and then fixes their life should be allowed to have their children back, with ongoing monitoring.
    Problem is...most agencies are so overwhelmed that they cannot handle the caseloads. Because of my personal circumstances, both of my caseworkers meet at my house for the monthly visitation AFTER THE SHOULD HAVE ALREADY GONE HOME FOR THE DAY. That's right, they go out of their way to help me because homes that will take teens are few and far between. Most teens get thrown into group homes. Dissociative disorders run rampant in group homes, and thats just a small example.
    Nothing is ever as easy as it would seem. Playing armchair QB is not helpful, it only hurts. There are a lot of good people out there who have dedicated their lives to helping children. Don't slam them all because there are problems.
  • There have been too many cases like this on our site. The signs of abuse are fucking billboards that can't be missed, but nothing is done.

    Coming down hard on the agencies who are supposed to help protect these kids just creates a hostile environment that will lead to typical government sloth, waste, and inefficiency.

    I propose this: We dissolve all government agencies designed to protect children. The government can't handle renewing our drivers licenses or coming up with an understandable tax code, why the hell should we entrust them with our kids?

    All you have to do is walk into a privately-run license/tag joint in Florida to see the difference. Or go to a small shipping store and compare it to your local post office. There should be some way to privatize child care services so that we have compassionate, interested people working there.

    I know it would feel "dirty", but there would have to be a profit motive for tracking these abusers down and protecting the children. Without that motive we have bureaucratic ineptitude. Either give the same tax money to small firms which compete for contracts, or levy fines on the abusers to cover the costs. Maybe the same people could take over our bizarre adoption and foster systems.

    This has more to do then her "penis". This grandmother raised that baby until Oct. (it sounds like) so there's no reason for her not to have given that baby back or not take care of him at all. She wouldn't have been choosing the penis over her kid, because she never raised him to begin with.

    I don't think she liked her own kid at all...

    What a wonderful world we live in when Britney Spears can lose custody of her children * no physical abuse* and here we have a poor defenseless NO NAME 2 year old who gets beaten on a regular basis and CPS doesnt care. That fat pig and her husband should be 6 feet under not him and I'd gladly put them down free of charge.

    That pic of little Jeramiah made me wanna cry. How can someone abuse a sweet little child like that? I'll never get it. And of course CPS did nothing when they were actually needed. I've stated here before that my husband and I are fighting BS charges to get our two daughters back and yet the children who NEED to be taken stay with the parents.
