Myers did appear to understand the questions, answered appropriately, and read back his Miranda rights when asked to do so, Daugherty said.

Detectives took a break after 45 minutes of questioning, then learned that a man arrested at Myers’ apartment said that Myers had been stabbed. When detectives resumed questioning, Myers denied that he had been stabbed, Daugherty said.

Detectives then asked Myers to take off his shirt. There was a large bandage on his back. Under the bandage, there was a two-inch wound that was consistent with a stab wound.

After a second break, detectives checked with other investigators who were interviewing James Wilson, Myers’ boyfriend, in another room. They learned that Wilson said Myers admitted he was stabbed during a robbery in Dayton in which a woman was shot, Daugherty said.

When confronted with this information, Myers made admissions to the crimes, Daugherty testified.

Tutkill, I’m sorry that it has taken me so long to respond to your comments towards me. I completely understand that you are mad as hell, but my anger is focused on the mistake that was made that night that caused all this destruction. It’s just unbelievable to me that anyone would keep all those personnal items in an unlocked, no car alarm vechicle. I have yet to be at a concert that doesn’t ask for I.D. when purchasing an alcholic drink at least in my state. Unless, they just had water and soda. The cellphone being left behind, I’ve done that. I still believe in my heart that Charlie was not alone when this happened. He was the only one who got caught. I believe that there is one more person that he trying to protect and I believe that person is someone that is close to him. Tut, it is a good thing that a person got caught for this crime, but wouldn’t it be better if The Nelson family really got justice by having everyone who was involved pay for the crime? My anger is also focused on The Child Protective Services Agency for overlooking the years of physical and mental abuse that poor Charlie had to endure. My opinion is still the same. Charlie does not deserve the death penalty, but he does deserve medical treatment. And just so you know, I’m not here to give you some story that I love him to start drama. I am a real person with real compassion for everyone who has been effected by this tragady.

His own roommate told police that he said he (Charlie) killed that woman who stabbed him while he was robbing her. hmmm roommate did not mention the other person. Plus the victim that lived did not mention another person. oh yeah Charlie himself has not told his attorney of a accomplice… Weird isn’t it that only the Charlie Myers defenders know of this great conspiracy.

Langer asked defense attorneys to have a post-hearing brief filed by Oct. 5, then told prosecutors to have their response filed by Oct. 26. Langer said he would rule on whether Myers’ statements would be suppressed by Nov. 9.

I don’t believe the statements will be suppressed, but it doesn’t matter if they are,I believe, there is enough forensics evidence against Charlie Myers to get a conviction.

DAYTON — Complaining about a cut on his back, Charlie Myers told a Montgomery County Jail corrections officer that a woman stabbed him, the officer testified Tuesday, Sept. 8.

When he asked Myers about how he got the cut, Myers answered “that woman cut me, then I killed her,” corrections officer James Davis testified.

The exchanged happened on Jan. 7, as Myers was being booked into the jail after he was transported from Columbus. During direct examination by Montgomery County Prosecutor Mathias H. Heck, Jr., Davis said that he asked about the cut because that is standard procedure after an inmate points out an injury.

Myers allegedly kicked open the front door of the Nelson home on Redder Avenue, where Nelson was cooking dinner. Her husband was at work at the time. Myers allegedly took Nelson and her son down into the basement, where he tied Nelson to a chair. He then took the boy upstairs and sexually assaulted him, according to prosecutors.

Nelson broke free from her restraints, grabbed a knife and stabbed Myers in the side, prosecutors said. Myers then shot Nelson twice with his shotgun, according to prosecutors.

Myers fled in a car, owned by a Nelson relative, with the boy, two computers and Nelson’s cell phone, investigators said.

now Charlies attorney’s are seeking to have his statements kicked out of court. You know that deaf thing he didn’t understand what he was saying. yeah right. Sounds like you knew what you were saying to your boyfriend-when you were running off your mouth.

Charlie Myers found competent to stand trial

DAYTON — A Montgomery County Common Pleas Judge ruled Wednesday, July 8, that Charlie Myers, accused of killing a Harrison Twp. woman and kidnapping her 4-year-old son, is competent to stand trial.

The ruling by Judge Dennis J. Langer came after two separate competency evaluations. Under Ohio law, a defendant is incompetent to stand trial if, because of his current mental condition, he cannot understand the court proceedings or assist in his defense.

Langer also set hearing dates from September 8 through 11 for the motions to suppress that Myers’ attorneys have filed

Father of kidnapped Ohio boy starts program to help children learn their own addresses

VANDALIA, Ohio (AP) — An Ohio man whose kidnapped son told investigators his address and phone number says all children should learn that type of information.

Travelers found the 4-year-old abandoned at a highway rest stop Jan. 2. His information led police to his Dayton-area home, where they found his mother fatally shot.

The man says his wife taught their son the valuable information, and he wants to help schools share that lesson with other children through a new safety program.

He told WBNS-TV he’s glad something good came out of the ordeal.

Prosecutors say 22-year-old Charlie Myers of Columbus, who pleaded not guilty to the murder, also had sexual contact with the boy.

The Associated Press is not identifying the family so as not to identify the victim of an alleged sexual assault

A great article on the prosecutors agrueing against a 2nd competency exam.

lead doctor on the first exam met with Myers on four dates for a total of nine and a half hours. Sign language interpreters were there at all times, the memo says.
Prosecutors argued that though some defendants cannot articulate the meaning of legal terminology when asked an open-ended question, they can still understand an explanation when given one. During his confession to police three days after Nelson’s death, Myers was able to identify legal terms such as murder and burglary “without any assistance or leading questions from the interviewing detectives and long before he realized it might behoove him to feign ignorance for purposes of a competency evaluation,” the memo says.
The memo also quotes the report by Dr. Barbara Bergman that noted that though Myers had suffered significant hearing impairment after contracting meningitis at age five, he has average intelligence and “appears to be very resourceful at getting his needs and desires satisfied, with well-developed survival skills.”
Myers can communicate well with the help of interpreters, Bergman wrote.
“At times, Mr. Myers appeals to his deafness as a rationalization for his objectionable behavior, presenting himself as a victim or a ‘tragic figure’ and at other times, he appeals to his deafness to elicit sympathy and lenience or to divert attention from his antisocial behavior,” Bergman wrote.
Prosecutors also noted that as part of the first evaluation, a second forensic psychologist also evaluated Myers. That was Dr. Robert Stinson, who is a specialist with regard to the hearing impaired. Stinson found Myers did not suffer from any mental retardation.

God, he is not retarded -imagine that. However, he is as mean and violent as ever.
