YoutubeYouTubeYouTube video above. If you cannot see it, your workplace is strict!

Farwell, Mich - Justin Gaskill, 27, cut the screen window of a home in the town of Farwell, slipped inside and forced an 11-year-old, who at first thought it was a prank, out of her bed at knifepoint. He then made the girl walk with him almost two miles to his home where he sexually assaulted her. He then let the girl go the next morning, warning her not to tell anyone what had happened. By time the girl made her way back home, the mother had already reported her missing and was outside talking with police. The little girl ran to her mother and told them what had happened. Based on her descriptions, Gaskill was located and arrested.

He was subsequently charged with two counts of first-degree criminal sexual conduct, one count of kidnapping, one count of home invasion, and one count of felonious assault. He was also put on a second-offense habitual offender notice which means he has fucked himself as well as the little girl, as a previous arson conviction will mean that he could very well receive one-and-a-half times the maximum penalty of these charges. That is, if he doesn’t reach another plea.

The fact that this was a random abduction, that the family did not know this man is scary enough. The family did not know this man. But if you read here, the comments include people understandably upset with the fact that the man prosecuting Gaskill is the same man responsible for the reason why he was out of jail in the first place. You will also see a comment from the mother of the victim explaining why she decided to go public with her name, as well as people who know Gaskill.

No defenders, thankfully, but some of these comments echo what we hear a lot in these stories at D’D, the fact that Gaskill may have had a mental illness, and that in school, he was a nice guy. But a couple of them stood out for me in particular, and those are the comments relating to him having a boy about the same age as this girl, and another commenter stating this isn’t the first time he has been accused of sexual misconduct with a minor. Now of course, these have not been confirmed, but I am sure they will be proven or disproved soon enough.

Anyway, I hope Gaskill enjoys his time in prison, where inmates may not look at raping an 11-year-old girl the same light as someone who commited arson.

Christ. Some people are scarily predatory. If I ever have kids, I’m teaching them what my dad taught me – if a predator gets you out of your house or into their car, etc., you’ll probably be dead anyway, so fight like hell before that happens. If only this child had screamed…That would have likely been enough to scare him off.

And, while I understand the very emotional “why was he out in the first place?” response, people need to understand that not everything warrants life in prison. This guy’s previous offense was an arson, right?

Yes, it was arson (his 1st CONVICTED i.e. caught and prosecuted case). Now he can add sexual predator and child molester to his resume. It has been statistically and scientifically proven that sexual predators have very high recidivism rates, yet they serve less time than someone caught w/ a pound of gank! We (society and the justice system) think too highly of these people and give too much credit to rehabilitation and 2nd chances! These 2nd chances cause stress and trauma in our communities that cannot be undone once committed…

I, personally, would rather live next door to a pot farmer than a child molestor or rapist! A lot of times when these people are caught for the 1st time (like this asshole here), it’s not their 1st time offending just their 1st time getting caught! It’s sickening and sad…and too unpredictable. We need to stop w/ the 2nd chances and hope for rehab…there is no such thing. I wish we could castrate these assholes and do unto them as they have done unto others…fuck that.

Actually, that’s incorrect. Sex offenders have a significantly lower than average recidivism rate. Come to think of it, this Wiki page breaks it down quite well.

I’m no fan of sex offenders, but misinformation is no good, either.

You know, the word “plethora” got me my first job? Well, it didn’t actually, but they said they knew they had to hire me, because I used “plethora” in my cover letter and that was their word of the day at the time. :P

I like to make information available to people so they can see for themselves. Misinformation doesn’t do anyone any good. Of course, I’m familiar with a lot of this stuff because I was wrong myself, once upon a time, and someone was nice enough to call me out on it.

Sex offenders having higher-than-average recidivism rates is a commonly perpetrated myth, so I don’t blame people who hear that somewhere and repeat it. It’s easy to believe, right? But the truth is, that’s not at all the case.

And since my word is gospel and all, I’ll take the opportunity to inform everyone that Morbid’s got an extra nipple.

This was probably one of his first offenses (sexual) because he actually let her walk home from his house….and didn’t kill her. When he gets out, cuz thats what they do let them out…next time he will be sure to kill her. This guy needs to be castrated….and jailed for life. Sad…but thank goodness she’s alive.

They don’t always get out. This amateur porn actor on trial for a break-in and rape at a WSU sorority is facing life in prison for the attack. There is hope that, because this dude has a record and is adding to it rape and kidnapping, he’ll not be released. Ever.

Life in prison doesn’t mean much these days when prisoners are repeatedly released with doing MUCH LESS than their full sentence.( If they weren’t “sentenced” to probation…?) I know in California you get credit for not “getting in trouble”, so in essence a life sentence just means whenever the jail gets tired of feeding and paying for him, he gets out. What’s with the crusade to show everyone they’re wrong on here? I think most would agree the VAST majority of pedophiles do indeed get out AND re-offend. Let the crusade be to get rid of these jerks….

    Recidivism

    * Of the 272,111 persons released from prisons in 15 States in 1994, an estimated 67.5% were rearrested for a felony or serious misdemeanor within 3 years, 46.9% were reconvicted, and 25.4% resentenced to prison for a new crime.
    * The 272,111 offenders discharged in 1994 accounted for nearly 4,877,000 arrest charges over their recorded careers.
    * Within 3 years of release, 2.5% of released rapists were rearrested for another rape, and 1.2% of those who had served time for homicide were arrested for a new homicide.
    * Sex offenders were less likely than non-sex offenders to be rearrested for any offense –– 43 percent of sex offenders versus 68 percent of non-sex offenders.
    * Sex offenders were about four times more likely than non-sex offenders to be arrested for another sex crime after their discharge from prison –– 5.3 percent of sex offenders versus 1.3 percent of non-sex offenders.

    Sex offenders

    * On a given day in 1994 there were approximately 234,000 offenders convicted of rape or sexual assault under the care, custody, or control of corrections agencies; nearly 60% of these sex offenders are under conditional supervision in the community.
    * The median age of the victims of imprisoned sexual assaulters was less than 13 years old; the median age of rape victims was about 22 years.
    * An estimated 24% of those serving time for rape and 19% of those serving time for sexual assault had been on probation or parole at the time of the offense for which they were in State prison in 1991.
    * Of the 9,691 male sex offenders released from prisons in 15 States in 1994, 5.3% were rearrested for a new sex crime within 3 years of release.
    * Of released sex offenders who allegedly committed another sex crime, 40% perpetrated the new offense within a year or less from their prison discharge.

So maybe I used a wrong term or plucked a nerve somewhere (I have a bad habit of spell checking my friends’ blogs, e-mails, etc.) But I think the facts above speak for themselves. Sex offenders are usually NOT successful at rehabilitation and tend to re-offend. There is no hope for child molestors, period. They do not deserve to breathe the air we do, they do not deserve 2nd, 3rd and countless “chances”, they do not learn their lesson and simply become law abiding normal citizens! They were never normal to begin with! Anyone who inappropriately touches and abuses children is a lost cause and deserves to burn in Hell! These stats are from the bureau of justice statistics. I think they accurately detail the society we are forced to live in and the people we have no choice but to live next door to and work with! 40% perpetrated NEW offenses after being released! This is almost half! Within a year! If that isn’t recidivism I don’t know what is.

Philly, you’re missing the point. As the statistics YOU wrote show, sex offenders are less likely to re-offend that non-sex offenders, meaning that compared to non-sex offenders, sex offenders do NOT have “very high recidivism rates.” Perhaps what you mean to say is that 43% is an unacceptably high proportion for this type of offense.

  17. Athena
    5:56 pm on October 28th, 2008

Plucked a nerve? Are you suggesting I’m defending sex offenders?

The following is the key passage in what you posted:

    * Of the 9,691 male sex offenders released from prisons in 15 States in 1994, 5.3% were rearrested for a new sex crime within 3 years of release.

That is what they base recidivism rates on. The recidivism rate for sex offenders as a group is roughly 5%. Not good, but compared to other types of criminals, sex offenders are much less likely to reoffend (as Lizard pointed out).

The 43% figure refers to the rate at which sex offenders are re-arrested for ANY crime (shop lifting, assault, DUI). 5.3% is the rate at which they are re-arrested for a sex crime.

  18. philly_phan

My point was supposed to be and intended as: SEX OFFENDERS DO NOT GET BETTER! They do not learn their lesson, they do not get out and become productive members of society. They re-offend and hurt more people! Drug dealers get more time than a child molestor! Forget the stats and facts: my only point was there is no cure for sex offenders. We can rehab addicts, not sex offenders.

I’d bet a million dollars that half or MORE Of those kids were raped and killed. Are you saying almost a million children missing each year…(with an additional 500,000 that ARE NOT reported) that those kids are just Misplaced????????????????????

Here’s some more info from the FBI:
    Oct 27, 2008.
WASHINGTON — The FBI says more than 600 people have been arrested and 47 children rescued in a three-day roundup targeting people who force children into prostitution.

The arrests by federal, state and local law enforcement took place in 29 cities as part of Operation Cross Country II.

At a news conference Monday, FBI Deputy Director John Pistole said the arrests were made possible by intelligence gathered during a similar series of raids in June.

The 47 rescued children ranged in age from 13 to 17. A total of 642 people were arrested. The FBI says they include 73 pimps and 518 adult prostitutes. The bureau said that it also dismantled a dozen large-scale prostitution operations that were run through call services, truck stops, casinos and Web sites.
    ______________________________________________
Are you saying that 16 of those arrested will re-offend? That is crap statistic…if this raid wasn’t performed…47 kids would be getting raped every day. Not a ONCE occurence; we’re talking prostitution and RAPE on a daily basis .

Very disgusting crime. I don’t know what is scarier, molestation by an acquaintance or by a stranger.

However, I was disturbed by this phrase right here:

“he has fucked himself as well as the little girl”

It doesn’t seem very sensitive to the child who was assaulted.

Are you kidding me? If half a million kids were being abducted and killed every year, we’d be tripping over bodies. Most children reported missing are not abducted. Most of those that are abducted are abducted by family. Stop being ridiculously alarmist. And then pay me my million dollars.

Sex offenders are usually NOT successful at rehabilitation…

WHAT rehabilitation? When do we ever rehabilitate any one in prison in this country?

We don’t. Sitting in prison is not rehabilitation. Having people go through what they do in prison sure ain’t going to make them model citizens if and when when they get out!

Maybe if we did, the re-offend rate would be vastly lower.

And as far as the mentally ill, we do nothing to help them either. The healthcare system in the country is one of the worst, and besides all the crime we have, we have the shortest life span and highest infant mortality rate of just about any developed country!

It’s a big joke, is what it is.

Just so everyone sees where I’m coming from, my 86 year old mother was murdered back in 1998. The man who did it, and who had just gotten out of prison for burglary, also murdered one of my childhood friend’s father.

This punk had been in and out of prison most of his life. He obviously got zero “rehabilitation” while in prison, so, what do we expect he’s going to do when he gets out? The only thing he habitually knows. There’s that “habit” word again, and he didn’t get a new “habit”.

And don’t get me started on how inept the police were in the whole “investigation”. Forget the sudden string of break ins since this guy had gotten out… no, they went after me. Until the second murder.. then they announced they had a serial killer they were looking for. They could have prevented that murder if they tried.

Like the story here about the cops not going into the woman’s house when she and her kids went missing. They don’t make an effort a lot of the time.

So sorry to vent, but our society is becoming dysfunctional, and no one is doing anything about it!

Never in a million years will I ever be able to understand an adult’s sexual attraction to young children. Nor will I ever be able to understand all those bleeding hearts who rally together to ensure that men/women who violate children , are protected and that their “human rights” are not compromised. Justin wore a bullet proof vest into court. How nice for him . Yes let’s make sure that the scum of the earth are protected and treated fairly for heinous crimes. Next they will lock him up in seg. so the other inmates can’t harm him. How nice. Taxpayers money will go towards feeding him his well deserved 3 meals a day, he will be clothed , have free medical care. They will most likely upgrade his education if he chooses that. Free dental. Things that millions of hard working decent people in America can not afford! I will not apologize for thinking he should be housed in the general population in prison. Let the inmates do what needs to be done. Men/women who prey on children , in my mind deserve to be treated like the trash they are. That pig took away the little girl’s innocence, he invaded the one place she felt most safe in and took her sense of safety from her. How does one equate life in protective custody with what the little girl will endure for ever? I just don’t get it.
For his next court apperance I hope someone with a sniper’s aim , puts a bullet through his worthless head.
My heart goes out to the little girl and her family. I hope that one day she will have come as close to full recovery as anyone who has been through this type of experience ever does.

Now, I was just discussing all this the other day w/ Castille. It may just be that I don’t want to face that the stuff I learned in classes was a waste of $$ (haha!) but,

My memory of how this works is:
    1) rearrest rates are not the best thing to base recidivism on. They’re just stats on, well, rearrest rates.
    2) 1-in-3 is the reporting percentage for all sex crimes, and is considered a low/conservative estimate.

Not to mention that perps figure out (I’d think…) better ways to get away with their offenses.

Which doesn’t mean some of my tuition $$ might not have been wasted, but that’s what I recall. ?? This is something I’d be happy to be wrong about, though.

Think you got something worth saying? Type it out. If you don't wanna look lame, get rid of that default avatar and go get you a gravatar! Tell 'em Morbid sent ya'. Lastly, as far as we are concerned, posting a comment means that you have read our Disclaimer.
