10/10/08 – Update – Minerva Lopez and Porfirio Olivas-Lopez waived their rights to preliminary hearings during a court appearance on 10/9/08.   They stood mute on the collective charges against them, prompting the court to enter “not guilty” pleas on their behalf.  Additional charges may be filed.

Madison, WI – Minerva Lopez, 32, and Porfirio Olivas-Lopez, 38, lived in an apartment on Pheasant Ridge Trail with their 5 children, including a newborn.    Neighbors describe them as “some sweet people,” and say, “We would sit and talk. She was nice.  They seemed happy.”   Apparently, looks can be deceiving.

It all started when a diligent worker from Dane County’s Joining Forces for Families program notified the Department of Human Services of suspected abuse.  On Thursday, September 25th, police officers visited the family to investigate those allegations, and found a child with “very serious” injuries: injuries they claimed would be life-threatening if not treated.   Officers transported the child to the hospital, took the other children into protective care, and arrested Porfirio Olivas-Lopez.  The next day, they came back for Minerva.

The neighbors (yep, the ones who thought these were nice folks), say that the couple’s oldest daughter was quiet and more withdrawn than the rest of the family.  They say she’s in middle-school or high-school, and that she’s the one who was taken to the hospital for her injuries.  Police will not confirm the names or ages of any of the children yet, but promise that more information on the case will be forthcoming.

While specific details of the abuse have not been released, but we can gather quite a bit from the list of charges.  To whit:

Porfirio is facing charges on 42 (yes, 42) counts, including 36 counts of physical abuse of a child with the intent to cause bodily harm, one count of physical abuse of a child with the intent to cause great bodily harm, three counts of strangulation, one count of causing mental harm to a child and one count of failure to act to prevent bodily harm to a child.

Mamma Minerva, meanwhile, is only facing 33 counts, including five counts of reckless child abuse causing bodily harm, six counts of reckless child abuse causing bodily harm, two counts of physical abuse of a child with the intent to cause great bodily harm, nine counts of physical abuse of a child with the intent to cause bodily harm, five counts of strangulation and six counts of failure to act to prevent bodily harm to a child.

The italics are mine, folks.  Strangulation.   And not just once, apparently.  I know some folks think it’s ok to spank your child.  I guess I didn’t realize that strangulation was a viable disciplinary measure, as well.  I must have missed that in parenting class.  Oh, wait, it’s NOT okay, you cretins!   Strangling your child will NOT make them respect you, it will NOT make them love you, and it will NOT even make them listen and behave.  It will make them hate you and fear you, and it might just make them DEAD.   Lay off the strangulation, and I mean it.

In the meantime, Minerva Lopez had a bail hearing on Tuesday, and is being held in the Dane County Jail on $25,000 cash bail.   Porfirio Olivas-Lopez has not yet had bail set, and is also being held on an immigration detainer.

    Ok I have been mad enough at my children at times that I have said I could strangle them but to actually do it. Maybe thats where I went wrong you know parents threatening to do things and then not following through. If you strangle long enough they will pass out or worse but hey at least you get a break.

She’s had visible injuries most of this year, but kept telling authorities they were self-inflicted or accidental, so they couldn’t/wouldn’t pursue it further. When she was found, she had numerous bruises and cuts, along with a broken right hand and right kneecap, which will require surgical correction.

    The actual charges filed in court today are fewer in number than predicted, but the details more heinous than I’d hoped, as in:

    “In statements to detectives, Minerva admitted to abusing her daughter by punching, kicking, hitting with a belt, hitting with objects such as a frying pan, cutting her with a knife, strangling her and pouring hot water over her. “I used just whatever I had,” she said. “I would never stop to think about the consequences.”

    The parents accused of badly beating their 14-year-old daughter with items ranging from broomsticks to belts to a frying pan were each charged today with multiple counts of intentionally causing bodily harm through child abuse.

    Cash bail was set at $32,000 for Minerva Lopez, 32, who recently gave birth to the couple’s fifth child, and at $22,000 for her husband, Porfirio Olivas Lopez, 38. Minerva was charged with 16 counts of child abuse while Porfirio was charged with 11. The incidents, which resulted in serious injuries to the child, occurred between April 1 and Sept. 25, when they were discovered by police.

    Although schools and social service agencies were involved before police were notified, the girl kept telling authorities her injuries were self-inflicted or accidental, blunting any chance social service agencies had of getting her out of the home, the criminal complaint against the parents says.

    Both parents eventually confessed to causing some harm to the child, according to the complaint.

    But when town of Madison police were sent to the home on Sept. 25, it became apparent the girl had been the victim of crimes, the complaint says.

    Town of Madison detective Rob Hale is quoted in the complaint as saying as soon as he saw the 14-year-old victim, “he immediately identified her as a victim of horrendous crime inasmuch as she was virtually covered from head to toe with bruises with various bloody wounds to the top scalp of her head, an open gash to her right cheek, various generations of bruises ranging in color from purple to green to yellow, and injuries that were consistent with what he later found were breaks in her right hand and a broken right kneecap.”

    Hale also described the girl as emaciated.

    Noted child abuse expert Dr. Barbara Knox of the University of Wisconsin Children’s Hospital examined the various injuries to the girl, and said she would need surgical treatment for the broken kneecap.

    Knox “indicated that (the victim) is potentially going to be suffering from life-long disabilities due to injuries sustained from the abuse, including but not limited to scarring resulting in permanent disfigurement and injuries leading to limb immobility,” the complaint says.

    Unlike many situations involving serious crime, there was virtually no argument in Thursday’s initial appearance over bail or the need for high cash bail because of the seriousness of the crimes.

    As Minerva and Porfirio were brought into the small courtroom in the Public Safety Building, they conferred, through the assistance of a Spanish-speaking interpreter, Jim Larson, and with assistant state public defender Ellen Berz.

    After that private conversation was over, Berz said she recognized cash bail would be set, and before the arguments about the amount got underway, Dane County Court Commissioner Todd Meurer interjected that recitations of the charges could be avoided if he set cash bail at $2,000 per count. Minerva faces 16 counts while Porfirio faces 11. Each of those counts carries a penalty of six years of combined prison and extended supervision time.

    The complaint says Knox diagnoses definite physical abuse of a child, severe child torture, physical neglect of a child, medical neglect of a child, educational neglect of a child — all consistent with causing great mental harm, as well.

    The complaint also shows the Dane County Department of Human Services has suspicions of abuse to the girl as early as April, when she showed up at school with injuries to her face. A friend of 14-year-old victim told a counselor that the girl said her mother hit her. But when asked, the 14-year-old victim said her brother threw something at her.

    “Human Services was not able to act upon the complaint,” the criminal complaint says, but on June 2 the girl again had facial injuries and on June 4 the girl had a wound on her head with dried blood on it. The girl again made up stories about how she was injured, the complaint says, but her friend told a counselor that the girl’s mother had hit her and told her she would strangle her if she reported it. The 14 year old told her friend that “she was afraid one day she wouldn’t make it,” the complaint says.

    Again Human Services took no action because it was not able to substantiate that the injury came from home, the complaint says.

    After the couple was arrested, the 14-year-old was hospitalized for treatment of her numerous injuries. Meanwhile the other four children — ages 8, 5, 3 and 2 weeks — were taken into protective custody and have now become the subjects of a juvenile court action.

    In statements to detectives, Minerva admitted to abusing her daughter by punching, kicking, hitting with a belt, hitting with objects such as a frying pan, cutting her with a knife, strangling her and pouring hot water over her. “I used just whatever I had,” she said. “I would never stop to think about the consequences.”

    Porfirio also admitted to beating his daughter, but on fewer occasions. He also admitted to twisting her arm backwards, punching her in the stomach and said he “used a belt a few times on her.”

    No real reason was given for the constant abuse, except that the parents portrayed the 14-year-old as being loud. It appeared they were concerned there were warrants out for Porfirio’s arrest, and they feared the consequences of police being sent to their Pheasant Ridge Trail apartment. Porfirio was convicted of drunken driving earlier this year and a warrant was issued for his arrest when he failed to show up to serve his 100-day jail sentence.

    Since his arrest on the child abuse charge, he has also been charged with failing to show up at the jail and is now the subject of a federal immigration hold, meaning immigration authorities are likely to seek his deportation to his native Mexico when his legal problems are over.

    Minerva is quoted in the complaint as saying she wanted to move back to Mexico after their fifth child was born because she knew law enforcement was looking for Porfirio, and she did not want him arrested.

    Cash bail was set at $32,000 for Minerva Lopez, 32, who recently gave birth to the couple’s fifth child, and at $22,000 for her husband, Porfirio Olivas Lopez, 38. Minerva was charged with 16 counts of child abuse while Porfirio was charged with 11. The incidents, which resulted in serious injuries to the child, occurred between April 1 and Sept. 25, when they were discovered by police.

    Although schools and social service agencies were involved before police were notified, the girl kept telling authorities her injuries were self-inflicted or accidental, blunting any chance social service agencies had of getting her out of the home, the criminal complaint against the parents says.

    Both parents eventually confessed to causing some harm to the child, according to the complaint.

    But when town of Madison police were sent to the home on Sept. 25, it became apparent the girl had been the victim of crimes, the complaint says.

    Unlike many situations involving serious crime, there was virtually no argument in Thursday’s initial appearance over bail or the need for high cash bail because of the seriousness of the crimes.

    As Minerva and Porfirio were brought into the small courtroom in the Public Safety Building, they conferred, through the assistance of a Spanish-speaking interpreter, Jim Larson, and with assistant state public defender Ellen Berz.

    After that private conversation was over, Berz said she recognized cash bail would be set, and before the arguments about the amount got underway, Dane County Court Commissioner Todd Meurer interjected that recitations of the charges could be avoided if he set cash bail at $2,000 per count.     The complaint says Knox diagnoses definite physical abuse of a child, severe child torture, physical neglect of a child, medical neglect of a child, educational neglect of a child — all consistent with causing great mental harm, as well.

    All of this is very true, great mental harm, which is psychological abuse. Add to this the psychological abuse of the other children in the family, who had to have witnessed some or all of what went on in that home. Watching this stuff done to their sister, very likely scared half to death that they would be next. This type of thing can typically bring on a lifetime of anxiety/panic disorder in the children who witness this stuff, over and again.

    I wouldn’t be surprised at all to learn these so-called ‘parents’ did abuse the other children in some form or fashion, even if they have no bruises or broken bones at this time.     former town of Madison man who, with his wife, abused and tortured the couple's teenage daughter was sentenced Thursday to 20 years in prison.

    Dane County Circuit Judge Stephen Ehlke said the abuse by Porfirio Olivas, 39, and his wife, Minerva Lopez, 34, “was just about the worst thing that can happen to a child.”

    A jury found Olivas guilty in December of 21 counts of child abuse, finding he had kicked, punched, strangled and struck his daughter with a metal tube between April and September 2008. He was also convicted of breaking the leg of his 3-year-old son in 2007.

    “This is an absolutely horrific case of child torture,” said Assistant District Attorney Corey Stephan, who asked that Olivas spend 25 years in prison.

    As he did at his trial, Olivas continued to blame his wife, said he had caused few if any of his daughter's injuries and was unaware of their extent.

    “I would never allow this to happen,” he said.

    Ehlke dismissed as “outrageous” Olivas' request that he be sentenced simply to the time that he has already served in the Dane County Jail since his arrest.

    Olivas will also spend 37 years on extended supervision after prison sentence, although it's likely he will be deported to Mexico when he is released.

    Lopez, who pleaded no contest to six counts of child abuse, will be sentenced April 6.

    The couple's five children are all with foster parents, and Olivas' sentence bars him from having any contact with them.

    Just another fucking case of social services and the shitty school system's dropping the ball and COLOSSAL apathy. Charges of negligence should be brought against BOTH agencies. Wisconsin needs to bring back the death penalty and broaden the list of capital crimes to include crimes against children. These people need to be destroyed. Couple of vampires have turned their daughter into one potentially. Pricks.
