Teens Charged With Sexual Battery On Student

SEBASTIAN, Fla. - A group of Sebastian River Middle School students were on a public school bus returning from a soccer game. At some point, two boys aged 14 and 15, pulled a 6th grade boy into the aisle. They then forcibly pulled his pants down and held them down, while the other stuck an apple pie box in the boy’s ass. The entire time, the other students were taking pictures with their cell phones. Not too funny, and my opinion, a whole lot of creepy. The two boys are now charged with felony attempted sexual battery on a child. Wonder if they are laughing now?
Of course, some will probably think that the felony charges are too harsh, but if this had happened to a 6th grade girl, would you still feel like they were blowing things out of proportion? No matter, really, as Superintendent Harry La Cava has stated why the charges were filed the way they were.
“We are taking the necessary actions that the law provides for us and the student conduct book outlines for us,†La Cava said. “The issue comes, ‘Are your children safe?’ Yes, we feel they are, and we’re going to make sure they continue to be safe.â€
The two students are no longer at the school and are currently in a juvenile detention center. The video report also states that there were teachers on the bus at the time of the incident, and that action will be taken against them if necessary.
You know what? I am inclined to agree with La Cava’s comments as well as the charges. We did some stupid shit as kids. I was even involved in bullying a bit…I am not talking from the side of someone who was ever bullied. But seriously, had I ever pulled a young boy’s pants down and attempted to stick something up his ass…I would deserve the harshest penalties allowed by law. It’s sexual assault. It’s not a fight, someone didn’t poor a drink on him, he wasn’t shoved…he was stripped naked in front of his peers and then had some teenagers stick something in his ass while people took pictures. Fuck ‘em and throw the book at ‘em while you are at it.
On a side note, the video report below does what they usually do with the zoom-in on the court documents technique. You can freeze-frame it and read a good bit of what happened on the bus, feel free to comment on what you read, but please do not post the teenagers names.

i agree with nadine and april here. everyone on that bus should be held accountable. what the hell were those adults doing that they didn’t see or stop or help that child? and the ones taking pictures, they should be charged for not coming to this boy’s aid. unfreakin’ believable.

Umm yeah this isn’t just typical bullying. He was sexually abused. I can’t believe no one stopped this….everyone was taking pictures with their cell phones. See this is what’s wrong with society, and sorry but my parents raised me better than that. There is just no way I could of stood by and watched something like that! If you can’t break it up, tell a teacher. I mean this kid is going to harbor this for the rest of his life. (shaking head)

If you read the document they zoom in on, you can read a bit about how when it first started, it was at the back of the bus and the boy repeatedly told these two idiots to stop, but no up front heard what was going on.
As for when everything spilled out into the aisle…well, I think that is also why they made a mention in regards to the teachers on the bus. I’ll try and keep the story updated as more information gets released.

Did they just not care (talking, gossiping, texting, etc.)? A school bus isn’t that big. Seems like they would of heard some of the confrontation at least, even before it spilled out into the aisle…..

This completely disgusts me. If this happened to my child I would be scared to see my reaction. I would want to kill them.

The charge is NOT too harsh! Remember being 12 or 13? Remember how horrible it was just to make the smallest error in front of your peers. This poor fellow may not get over this anytime soon, if at all!

Here is something I would like to know. Where do children (teens) come up with this stuff? Do they see it on TV or something? I am just so upset with all of this…..how could anyone do this to a child, and on a school bus AND with teachers present! OMG, this is so horrible….sort of makes you wonder what the parents are like now doesn’t it? I would be willing to bet, this is not the first time these children have bullied others, hopefully now it will STOP!
I feel so sorry for the child that this happened to, he will never get passed this.

I feel so bad for this little boy, I can’t imagine this happening to one of my children or my grandchildren… I also can’t imagine my reaction to this, and I’m usually very much in control.. I’d be borrowing my son-in-laws gun ( he’s a cop) and doing something terrible.. That’s why I don’t own a gun… That german-irish descent can really blow.. My heart goes out to this little boy…

Stupid punks. I hope their parents are horrified at their actions. Wait til they hear the crime in juvie hall. I don’t wish that type of assault on ANYONE but I would not be surprised if the juvie hall regulars didn’t try to give them a taste of their own medicine. I also hope the punks’ parents get the assaulted boys counseling bills for as long as it takes for him to recover. Is the assaulted boy still at the school or are the parents planning on moving him far, far away?

What I want to know is why was a 12 year old (6th grader), in the same bus with 15 & 16 year olds? At that age they should have been in high school. Teens and smaller children should never be together. I have 2 teenagers, 1 preteen, and a 3 year old toddler (yes I am exhausted). My preteen is with kids her age, the teens hang out with kids their age, and my 3 year old with toddlers. They are all in different stages of development, therefore, you don’t leave kids that age together. It won’t wipe it out this type of abuse completely, but at the very least you know they aren’t being bullied by older kids or abused. This is still a little boy. These two pieces of shit , overpowered a boy!

Is this place a small town? When I grew up everyone from a certain neighborhood rode the same bus and then the bus would drop off the kids at the different schools. Kindergarten through High School…all the same bus.
What I want to know is when did it become funny to stick something up someone’s rear in school? From what I remember, you didn’t want to get anywhere near another person’s asshole, especially if they were the same sex as you. You would think that the bullies would be ridiculed more than the victim here. Two guys having a fixation on putting something in another male’s rectum?
Yeah, I’d be the first one to start questioning these guy’s sexuality…and I bet they’d lose their minds over it.
They ganged up on someone smaller and younger than them and put something in his ass. You can’t get more sissy than that folks.

Okay – I went back and watched the video. It was a 14 and 15 year old and the victim (YES, VICTIM) was 12. The bus was transporting them to or from a soccer game. It also states the kids taking pics were teammates. If you stop the video and read the report – it shows that the incident was about 2-3 minutes. Where the fuck were the adults? I strongly feel that there is some blame to be placed there as well.
BTW- Does anyone remember The Breakfast Club? Where Emilio Estevez says that he taped the hairy guys ass cheeks together?? That is all I could think of here.

OMFG, that’s just enough. It’s bad enough there’s this insane obsession with prison rape around here, but now we’re advocating for the sexual assault of a 14 year old BOY?! Pardon me while I puke. Rape is rape, and it isn’t any kind of civilized penalty for a crime – assuming we aren’t all sexually demented criminals ourselves anyway. So I guess I’ll just speak for myself. I know the horrors on this site get people worked up into a vengeful rage, and I generally ignore it. Even though I feel it’s more likely your 18 yr old son busted on a pot charge is going to be the one sexually assualted by those hardcore predators, not the other way around like people prefer to fantasize. But I can’t ignore this one. The casual way in which anyone can even subtly suggest that 14 and 15 yr old boys ought to be raped *no matter WHAT they did* is just too fucking much.

I find it very hard to believe that the teachers in the front of the bus couldn’t hear him screaming – and if they really couldn’t, they weren’t doing their job in controlling the chaotic atmosphere on the bus.
I never understood why teachers sit in the front anyway. If their job is to watch over the passengers, shouldn’t at least one of them sit in the back?
The two little rapists (and that’s exactly what they are) will have to be monitored now for the rest of their lives. You think they’re bad now, just wait.
I had a friend who went to juvie for stealing. When he got out, he was much worse – scary to even be around. I’m not saying that the punishment isn’t fitting, but sometimes I think kids should receive a little better rehabilitation in those places. They are, after all, still kids.

Um, NO THE PENALTY IS NOT TOO HARSH.
Not only did a RAPE take place—specifically ANAL RAPE—but the people who took pictures and/or video of it on their cell phones were making child pornography. Just because the perpetrators were under the age of 18 doesn’t make this “harmless kids’ stuff.” Think back to when you were 14 or 15. Let me guess: you already knew that forcibly sodomizing another person was wrong, right??

Okay I have a question. The team mates that sat there and took pics of the assualt..why have they not been arrested for making child porn (as XENU pointed out above) Thats what it is… the victim is a child, so throw the fucking book at them too.

I am disgusted with this. The penalty is not too harsh. This is sexual assault. Where were the adults on the bus? Too busy talking…whya re they on the bus if they are not going to supervise these kids. Just goes to show the mob mentality…kids took pictures instead of helping the victim. I’m sure some of them knew this was wrong but for fear of being the next victim or becoming an outcast they chose not to help. Very fucking sad.

An eye for an eye, isn’t this how it should be? Those boys need to know the true humiliation & exactly what that younger boy went through. I think it out to be done on a bus full of their peers, just to even it up. I also feel that every student who took pictures and every adult on that bus needs to be held accountable for their actions, or lack thereof.

the truly main problem here is that in March the Sebastian river high scool baseball team was on an overnight trip an a student was held down by his teammates, his pants were removed and they tried to insert a 2 liter bottle in his rectum. Dr LaCava said he would just have to deal with it and the students involved will be eligible for the team this year. If the superintendant of the school district would have been strong against the students involved, I truly believe this second incident would not have happened.

These kids had NO BUSINESS doing this to the other kid & I’m glad they’re being punished. They should’ve learned a LONG TIME ago, (kindergarten!) to leave other people alone. This is nasty bullying behavior.
My son as a preschooler, had a friend who was always ALL over him, taking toys away, hitting & pulling hair. Even when she was hugging him; it wasn’t nice, it was like it was against his will, and too rough…I know small children often don’t know about personal space, but they need to be taught. I always wondered WHY the kid’s Mom didn’t tell her to keep her hands to herself, or to be more gentle. I think this is how bullying starts.

Actually I think all the kids — shovers, photographers, audience — could be questioned in an assembly or on video one by one. For the bystanders, pretty much the same thing, “I get that you thought this was okay or funny or interesting because you took ten pictures of it with your cell phone. I’m just looking for what was going through your head. If you thought it was entertaining, maybe you wanted something shoved up your anus, too. No? You think it would be painful? Yes, I am venting, as this article pisses me off, but I do feel that the punishment should fit the crime no matter what the crime committed. No sick fantasies here, but if the two boys in this story were subjected to the same brutality and humiliation that they bestowed upon the 11 year old boy, then yes, I would feel that some sick, perverted justice has been served. Enough said.

Yeah. I know what you’re saying. But to have that kind of justice system would indeed be truly “perverted” justice. It would take a real monster to inflict the punishment, that’s the problem. Some other sick fuck rapist would have to do it, which would mean that the sick fuck rapist would get to have their jollies and bust a perverted nut. I know what you mean, though, and I’m sure Castille does, too. We all feel paralyzed about what to do in response to a horrible case like this. We are all together in that.

This poor kid will eventually leave his hometown, never to return. No High School Reunions will ever be attended because this young man will FOREVER be a victim of humiliation and pity by his peers. My worry is that he will have self-esteem issues and will never see himself as worthy of being above average in anything he pursues in life. These are the permanent scars that may never be erased, and even if they beat the bullies black & blue in the Public Square… those scars will still remain.

Woosh! Get some counseling? I know people who’d never dream of returning to a reunion, who are nothing but annoyed and angry when people from grade school try to friend them on facebook… But have also moved out, away and left it behind them by choice. I’ve a whole peer group of geeks for whom life really opened up and began past their school years, and who realized their grade school bullies were more meaningless than they could’ve ever seen at the time in the larger picture of their lives. Fovever be a victim? *Really?* Damn, you do that shit to yourself.
