Harrington, DE - Meet Mack N. Smith.   Mack was convicted on Jan. 7, 1997 of engaging in unlawful sexual intercourse with a victim under the age of 16 (the conviction record says she was between 12-15 years of age).  He served some time, and is a registered sex offender designated as a “Moderate Risk” by the Delaware State Police Sex Offender Registry.   He lives on Dormon Street, occasionally goes by the alias of Malcolm M. Smith, and is listed as unemployed.  But being unemployed doesn’t mean he hasn’t been keeping busy.  Oh, no it does not! 

You see, on September 3, the police department was contacted by the Division of Family Services to investigate a reported rape of a 14-year-old girl at a home on Dorman Street.   Investigators spoke to the girl, and learned that between July 23 and Aug. 15, 32-year-old Mack forced the victim into his home, held her against her will and raped her.  Police say Smith threatened the victim with physical injury if she told anyone.  It’s unclear from the information available whether she was held that entire time, or whether there were multiple attacks.  I’m sure that will come out in time.

Whatever those details, police in Delaware deemed them sufficient to charge Mack with eight counts of first-degree rape, four counts of second-degree kidnapping, four counts of unlawful sexual contact, four counts of terroristic threatening and four counts of endangering the welfare of a child.  That’s a boatload of charges, Demons, and they bring joy to my heart.  But wait, there’s more!

Apparently, Mack didn’t really think more jail time fit with his plans, so following his arraignment, Mack  broke free and ran out of the police department!  Run, Mack, run!  He tried to hide in a home on New Street, but police located him and brought him back.    Why is that good?   Well, for the privilege of a few fleeting moments of freedom, police added charges of second-degree escape, resisting arrest, disorderly conduct, pedestrian crossing at any place except marked crosswalk and third-degree criminal trespass.

Giggle.  Yes, they charged him with Jaywalking!  Isn’t that awesome??

In any event, Mack N. Smith is now jailed with a bond of $193,502 (I love round numbers, too, DE!).

As an interesting aside, a poster in the comments section of a local news station (WBOC) claims to have been his neighbor, and says that his wife had no idea he was a sex offender.  When she found out, and divorced him, HE was granted custody of their children (2 daughters and a son).  I am seeking verification of this, and will update with anything I find.

    I can’t believe that for a second. I mean, it’s possible that the court system could have fucked up so grandly, but unlikely. If anything, he may have had joint custody that neighbors mistook for full custody.

    I agree with you Athena. I haven’t been able to find any information on it, as I think custody documents are not available for public consumption. I’m still digging, but nothing yet to confirm or refute this.

    I Love that one.
    Now lets all hope and pray that all those charges end up charged and not rolled into a pretty plea bargain ball that will allow that Jerk arse out in another few years to repeat what the courts have allowed him to repeat already.
    Yes I know he served his time before and the law states they must at some point allow them to come out. Damn pesky rights and laws.
    If they stop playing let’s make a Deal though and have a good Judge he Just may end up in that place so long that he will never be able to hurt another kid.
    Frankly I say screw 3 strikes when it comes to kids if you get out and do it again toodles we will not allow you ever to see the streets.
    but that is in my perfect world.
    I wonder if these child visitation thing was done as said partial and they did it cause they knew he was going to jail and would not have to worry about it ever happening LOL
    Possibly they added special instructions like only with a chaperone or something too. At least you would think. If not can they Appeal those type things??

    I am not agreeing that this is what happened, but I will say this:

    My Son’s father had a huge arrest record for drugs and violence. He was a Heroin and Meth addict. When my son was 3, his dad threatened to kill me at work. My boss was on the phone, and heard the whole thing, after I flagged her down to pick up the phone and listen. He showed up at my house later and beat down my door with a gun (hitting it so hard he split the wood). He later, when cops caught up with him, told the cops that it was his “Friend” who was “kicking” down the door and he “made him stop”. This was bull because my roommate and I both watched him while calling the cops. He was alone, and had a rifle or something. Anyways, I ended up fleeing with my son to a Women’s shelter alllll the way across 7 states! When CPS came to talk with me about what happen, the stupid bitch said she thought my son should be with his dad because his dad “has a house” and I am in a shelter! THE NERVE! I asked her, “Did you forget WHY I am here?”

    So, to make a really long story short, that bastard DID get custody of my son for almost a year! I had a home, a job, and stability for my child. But that CPS worker made it impossible for me to “look better” than the dad’s situation. I had a home, but mine was an apartment and his was a house. I had a job, but I was a Vet tech and he owned his own business. I lived with a roommate and he had a wife. Also, my son’s half sister lived there too. So the CPS worker and Judge decided to IGNORE all circumstances and they gave my son over to the dad.

    Here is the clincher…

    Shortly after, the dad COMMITTED suicide and SEVERAL drugs were found in his home. Along with, no electricity, no phone, no food, place trashed, several needles laying around, and no wife around either!

    Needless to say, my son has been back with me for years now and, yes, he is still scarred over the horrendous act he had to witness his own father do. This could have been prevented if our system was not flawed.

    Oh, and my friend Sarah?? Her kids were handed to her drug addict husband as well, JUST BECAUSE HE WAS A JUDGE, only, sadly, those kiddos are now 6 feet under ground. :(

    well he raped once, convicted then let out and rape again, wow not a surprise is it???????
    Well i hope he f…. dies and gets raped in prison by a whole lot of big big big men

    I KNOW, right? I’m glad most of the perps aren’t so pretty. It sucks to say it, but it’s easier to hate the ugly ones for some reason. I’m weak. And I think it’s an older mugshot, as it’s the photo in the Delaware Sex Offenders Registry. Not a great place to go cruisin’ for handsome men, ya dig?

    Ok, tell me that is not true he was given custody of his children?? Even joint custody?? That poor girl, only 14, so sad. I think that CPS better check his own kids out, no matter what age they are.

    Oh and the jaywalking? Priceless!

    I think they’re saying he got custody after the 1997 incident, which his wife found out about and left him over, causing a custody issue. Now, if we think about the original charge, it could be as benign as having had consentual sex with a teenager as old as 15 at the age of 21. Inappropriate? Sure. But not bad enough to cause the courts to restrict custody. THIS is bad enough, though, so I doubt we’ll see any more favorable custody rulings.

    I am not agreeing that this is what happened, but I will say this:

    B…your story is heartbreaking and also infuriating. And also one told all over the world. I volunteer in a women’s shelter over here. They can repeat your story word for word. It makes me want to cry. What can we as a society do to help women like yourself and your friend Sarah so that this situation does not keep on repeating itself?

    As far as this POS goes…I hope he jaywalks himself right into jail. Jaywalking is a great charge, though. :)

    You know, I was going to say something yesterday, but thought it might be a little harsh, so I decided against it. But, now that another comment has been made, I just can’t help myself.

    Are we talking about leagues of men who are fine, upstanding citizens right up until procreation, at which time they snap and become abusive monsters? Not to say that doesn’t happen, but seriously. Most women I’ve met in that situation knew full well that their boyfriend/husband has abusive tendencies well before they married/procreated with them, but stayed that much longer for some idiotic reason. I’m not playing “blame the victim” by any means, but boy…The world would be a better place if everyone in a relationship exercised a bit of judgment. Spend a little time with a person before popping out their kid, huh? Give some time for the red flags to appear before sticking yourself in a tough situation to escape from.

Spend a little time with a person before popping out their kid, huh? Give some time for the red flags to appear before sticking yourself in a tough situation to escape from.

    Just like to state that I know this guy personally… and the prior was a case of the girl lying about her age. Not that I’m trying to sugarcoat anything. While, I’m shocked about his recent bout with the law…quite frankly it doesn’t surprise me.

    As for his kids… he divorced from his wife…2004 or 2005. He got custody of them some magical way. And I’m pretty sure she knew he was a convicted sex offender… he was also an adulterer…(and has other kids) and apparently the stupidest man on earth… fleeing from the court? wow…
