MARTINSBURG, W.Va. — A jury in Berkeley County Circuit Court deliberated less than an hour on Thursday before finding a Hedgesville, W.Va., woman guilty in connection with the death of her 7-month-old son in August 2008.

Boggs could receive between 10 and 40 years in prison for causing the death of Skylar Boggs and one- to five-year sentences for the other two counts. Berkeley County Prosecuting Attorney Pamela Jean Games-Neely said 23rd Judicial Circuit Judge Gray Silver III will decide whether Boggs should serve the terms of imprisonment consecutively or concurrently.

A sentencing/post-trial motions hearing was set for Nov. 2.

“I just lost it,” Boggs told Sgt. David E. Boober in the first of two taped interviews the night of Aug. 20, 2008. “I belong in jail because I killed my son, but I didn’t mean to do it.”

In a taped interview with Boober, Boggs said she threw a baby bottle toward the boy while he was in his crib two days before she threw him in the crib, because the child was crying and not being cooperative and she became upset. That incident resulted in a black eye, which she lied about to her mother and boyfriend, she told Boober.

Boggs told police she was stressed at the time with the circumstances of her life. She was jobless, financially strapped and wanted to go back to college.

“I can’t do anything because of the baby,” Boggs told Boober in the first recorded interview.
Boggs’ boyfriend, who was not the boy’s biological father, testified that he noticed the child had “a weird look” on his face and his eyes were “kind of bugged” the night before he died.

He said he also noticed the boy appeared to “daze off” and his mouth was open and his cheeks were puffed. The boy also pulled at his ears, he said.

Jurors were expected to hear closing arguments today.

A woman accused of causing her infant son’s death was under stress and “snapped” while caring for the boy, but she did not maliciously or intentionally injure the child, her attorney said Tuesday during opening statements in her trial in Berkeley County Circuit Court.

“I want you to see the type of person she really is,” defense attorney B. Craig Manford told a jury of seven women and five men.

The fracture of the boy’s skull is believed to have occurred Aug. 18, when his head struck a hard plastic toy piano when his mother put him in the crib, Manford said.

The attorney representing a Hedgesville woman charged in the death of her infant son filed a motion Monday seeking to exclude autopsy photographs of the child’s skull at trial based on an argument that they are too “gruesome” and may be prejudicial to his client.

The three photographs in question show the baby’s skull at various stages during an autopsy.

Games-Neely said the state does plan to use at least one of the photos, which shows only the child’s skull and the large fracture at trial. The state originally planned on using X-ray photographs of the child’s skull instead of the photos, but decided against it because of poor resolution.

“This is not a small fracture. That’s a major fracture,” Games-Neely said.

However, she argued that the problem with showing the picture in black and white is that the fracture itself is less defined than when it is shown in color. That’s partially because infant’s skulls are not yet fully fused into one single bone.

“In black and white, it’s very difficult to to tell if it’s an injury or if it’s just a line in the skull,” Games-Neely said. “That’s why we are asking to use the color photographs.”

Silver said, “There’s no denying that’s a relevant photo.”

Manford requested that the photograph be converted to black and white, so it doesn’t cause prejudice among the jury against his client.

“It think it’s pretty obviously something prejudicial,” he said.

Manford objected more to the other two photographs Games-Neely showed Silver. One of the photographs showed the skull with part of the skin tissue still attached and the scalp pulled back to the base of the head. It also shows some pooling blood and evidence of a possible subdural hematoma, which is a form of a traumatic brain injury.

Manford requested that the photo be altered so that the excess skin cannot be seen.

“I would ask that it not only be cropped but that it be in black and white,” Manford said.

He reserved his strongest objections for the third photograph presented to Silver on Monday.

That photo shows an internal view of the infant’s skull after the brain was removed. The purpose of the photo would be to show the amount swelling the baby’s brain sustained and its effect on the skull.

“It looks like something right out of Hollywood,” Manford said. “It’s just so horrific. If anybody has an argument for a prejudicial photograph, that’s it.”

While Manford argued strongly against the use of the photographs, Games-Neely said she might not even use the last two pictures during trial.

“The odds that we are going to use them are very thin,” she said.

However, she said she might be forced to use them if the defense opens the door to their use during testimony.

Despite the graphic nature of the photographs, which Games-Neely admitted was the case, she said they could still be viewed as relevant during trial if the need arises.

“If you create an injury, you should be able to show that damage as it exists,” she said.
