Decatur, TX – I covered this case briefly back in February here, but at the time, I said something really stupid – or really telling. I said “Texas does not like babykillers unless you cut a deal.” Three months later, that’s exactly what’s happened.

On February 17, 2008, Jaclyn Pennington called 911 to report that her three-year-old daughter Taylor-Rae Baker wasn’t breathing. Taylor died later that day from internal bleeding and blunt-force trauma to the head. Why? Because Jaclyn Pennington threw Taylor into a brick fireplace – head first.

Taylor-Rae Lenette Baker lived with her father, J.T. Baker, her sister, Triniti Baker, and her paternal grandparents in Fort Worth. But the weekend of February 15, Taylor-Rae was on a visit with Pennington, her noncustodial mother, and Pennington’s husband Rickey.

Within two days, she was dead. Jaclyn Pennington later admitted to investigators that she lost her temper with Taylor-Rae and threw the toddler into the fireplace, cracking her skull. Taylor-Rae was beaten until her insides bled, and she died.

When Jaclyn Pennington was initially arrested eleven days after Taylor-Rae’s death, she was charged with capital murder and held on $1 million bail. To the Texas Rangers, it looked like an open and shut case. But when the Wise County District Attorney, Jana Jones, got the case, she sent it to a grand jury with a charge of “injury to a child”, which is how the grand jury returned the indictment. Murder wasn’t even an option for the grand jury, because DA Jones didn’t think she had enough evidence.

Um, a confession isn’t enough evidence? A dead baby isn’t enough evidence?

Apparently not. Thing is, Jones seems to think that possibly Rickey Pennington contributed or caused Taylor-Rae’s death. But she can’t prove that either, so Rickey Pennington is charged with “injury to a child” as well. “Injury” to a child who is now dead. The way this case has been handled, Jaclyn Pennington and her husband could be given a much lower bond and walk out of jail pending trial after her arraignment on the new lower charges.

Taylor-Rae’s father and paternal grandparents are angry. As should we all be. Texas was the last place I expected to see pull this kind of babykiller mollycoddling. I’m disgusted. There really is not going to be justice. Not for Taylor-Rae Baker.

    I would like to first thank you for what you said about this mess up charges. Yes I am the Grand Father of Taylor-Rae and we are so upset with the D.A. in Wise Co TX. The Rangers had her on Capial Murder and Wise co. is to scare to go to court and get justice for our little 3 year old girl and get murder charges on the one that said she did it. What the hell is wrong with this? And even with all that my son is having to do with this her family is still trying to take his other daugther away from him and he didn’t do anything but took care of these girls by himself she didn’t even paid child suport. And the law is going to let her and her husband get away with it.

    That is what we think it could have been anything. But not murder cause Wise Co. D.A. doesn’t care about a girl little that dies by her own mother and what the father or family is going to have to tell this other little girl what happen. Because she was there when it happen too and what did she see. And her and her damn family doesn’t give a damn,cause if they did they wouldn’t be doing this to our son. But it just show you that there is alot of sick people out there.

    Yeah, this whole thing is a travesty. Your grandbaby deserves justice, and she’s not getting it from Jana Jones. Because what’s gonna happen is both parents are going to do minimal time by blaming each other for Taylor-Rae’s murder, and although the sentences can go to 99 years, I don’t see that happening with a DA who won’t even press a manslaughter charge.

    It sucks. And nothing I say can make it better, but I am so sorry.

    Thank You …But there is more you can say and that is keep YELLLING you asses off about these little babies and how sick the ones doing it is and maybe some damn day the law will do something about it. And asshole like in Wise Co will not get into offices and let them get away with it. So keep yelling for him. And you havn’t even heard the whole story about this, there is alot that isn’t even out there about yet, but it is coming soon….Thanks again for all of you people that really do care about the little baby.

    JBCB – I’m so very sorry for your and your family’s loss.

    I’m outraged at the DA’s handling of this case. You stated there was no way to get more serious charges. I was just thinking, can you not write letters to the governor, judges, her superior, anyone and try to have her decision investigated? Did she get paid off? Does she know someone close to the other side? – Is there possibly anything like that in which your family could use?

    I thought charges or indictments could be amended, as needed. Maybe you could get the charges amended if you can find fault with the DA. I’m sure the Texas Rangers aren’t too happy with the DA’s decision, either.

    I would start with calling anyone in the district, then my state representative, my congressman, and the governor. In addition to phone calls, I’d mail the same people letters getting all family members and friends to write their own letters, as well. Flood their offices with this injustice.

    Surely to Pete, if a governor of a state can stop an execution of a convicted criminal, then can they not “put the charges on hold” (for lack of better words) until an investigation into the DA can be done? Or can the governor force additional charges based on the evidence the rangers have? I know I’m grasping for straws, but maybe just maybe, if you can’t use one of my ideas, it will spark something in your head that might be successful. Bitch ’till you run out of air and then have another family member take over.

    I pray this shit will not flush!! Keep trying! My prayers are with you guys not only for your loss but also praying you can find someway to see this injustice corrected.

I am that little girls voice now and they will have to put me where she is to shut me up any more. It is time that the people out there know what happen and is happening to her and her sister and her father. I will make it but I am so damn tried to see what her and her family is doing to him, when he was cause trying to take care of the girls by himself no help from her the mother well so called mother.     I am Rickey’s aunt. First let me say that our entire family has grieved for Taylor and we greatly miss her. I also wish to say to the grandfather how sorry I am that he has lost this precious baby granddaughter and that his entire family has been in our prayers. We too are amazed that the charges were reduced and that Jacque was only indicted for first degree injury to a child.

    Please allow me to tell you what we were going thru and what we saw and observed in the week or so after Taylor’s death. Although my sister was only the step grandmother to Taylor she dearly loved her. She had been around her since she was about a year old. My sister was devastated at what happened. She was awakened that morning by my nephew screaming for her to come help him that something was wrong with Taylor. And I mean screaming litterally because that is the only way she would have heard him from the living room with her bedroom door closed and a box fan running. She is the one that did CPR on Taylor until EMS arrived. Can you imagine yourself in the situation of having to do CPR on a grandchild and not knowing what in the heck has happened to this precious little girl. She was the one that handed Taylor’s older sister and baby sister, who is my sisters grandchild, over to CPS when they came that afternoon.

    When we were told that there was obvious signs of abuse and that it appeared that someone had harmed Taylor we were shocked, confused, and angry. Jaque led us to believe that the father had harmed her before she picked them up. (Contrary to reports, the girls were not dropped off to her in Decatur she picked them up. Now we have no idea if she picked them up from the father or from her own mother’s home. So many untruths have been told that we are still unsure what to believe about some things.) Facts were being released to us in tidbits and some down right untruths were told by the police in an attempt to get either Rickey or Jacque to confess to something. By Thursday it was clear that the police felt that Rickey was some how involved in harming Taylor. Rickey volunteered to take a polygraph, no one else did. Why would a guilty person volunteer to take one? As a family member you don’t want to think that anyone, especially not one of your own, could harm a child. He assured us that he did not have anything to do with Taylor’s death. We believe him.
    He took the polygraph on Thrusday afternoon. It was inconclusive. After arriving home from the polygraph he got a call from Jacque who was at her mothers telling him that CPS said he was not allowed to come to the funeral home. We found that very strange that CPS could have that authority seeing that the girls were not going to be there.

    We found out later that was just one of many lies that she told. You see she did not want Rickey there because she knew that he would break down and end up telling what happened. She had told him the night it happened that she had thrown Taylor and that Taylor had hit her head. We do not understand why he did not tell other than he had felt that as her husband that he had to protect his wife. No other explaination makes any sense.

    Then on the day of the funeral Jaque said the funeral home told her that CPS told them Rickey was not allowed to be there. Another lie. So it was no surprise when a week after Jacque confessed she decided to change her story and add that Rickey helped her throw Taylor. Oh and did I mention that Rickey was sick in bed with the flu that whole weekend and that it turned into pneumonia by the day of the funeral.

    Jacque did admit what she did to Taylor. There is a taped confession, written confession and letters she wrote to Rickey admitting to all the facts. It took her nearly two weeks to admit to them but she did. The DA is charging her with what she knows she can convict her on. It is sad that that is all they can charge her with but without intent to commit murder it is the best that they can do and make sure that she is convicted. How horrible would it be if they charged her with murder and then could not prove it and she were to get off with a slap on the wrist.

    As far as them getting out on bond is concerned. We can not afford bond and so Rickey will not be getting out until they decide that they do not have enough to indicte him or after he finishes a sentence if he were to be convicted of something. They can charge him all day long but until they have an indictment they have nothing. If he is indicted we will deal with it as it comes.

    We believe he has done nothing other than stupidly marrying a psycho and then having some odd sense of honor that made him think it was his job to protect her.

    Yes someone should pay. That someone is in custody and the mother of the child.

    I want to clarify a few things especially the last sentence. I meant to say that someone is in custody and is the mother of the child.

    I want to make it clear that until Jacque confessed we did not know what had happened nor did we know that she had told Rickey until after her confession. We had suspected that there was just something not right with her account of that morning. We are all still shocked that Rickey did not come forward and tell what happened.

    We will probably never know the reasons for a lot of what happened that day as most of it defies reasoning. What we do know for sure is that Taylor is gone because her mother thru her across the room head first into a fireplace. We know that we will never see that smiling face again because her mother thought it necessary to harm her. We know that she will be greatly missed and we hope and pray that all of the truth comes out in court and that the person responsible is held accountable. We are sorry for all the pain the father’s family has suffered and indured but they should remember that there are others that have been greatly affected by her death that also loved dearly.

    I personally would like to appologize to the father for thinking that he had anything to do with harming Taylor. We now know that all the tales Jacque told were just that. She was doing whatever she could to get the attention on someone else and off of herself. So Mr. Baker, if she would tell the lies she did about your son don’t you think she would tell just as many about her current husband?

    And you are so sorry you have been sucked into this evil family too. Our only wish is that Rickey would have said something right away , so that maybe our son could have been able to spend her last hours with her daddy. And we will never get to say we love her again .
    But we can’t understand one thing and that is everyone talks like it was the blow to the head that took our baby’s life , and it was the blow to her little stomach that killed her. And the Dr. said that, that the only way this could have happen was with intent to do it. With a HAND or FOOT and no ones seem to want say why that happen. Cause if it would have been from the fireplace they could have fixed that and our Tay-Tay would still be here.
    But again we are truely sorry you have gotten tangled into this evil web.

    I can’t say for certain but I believe that the stomache injury was explained in the confession or in one of the letters to Rickey or one of the taped conversations. I only know what was told to my sister and what she related to me. The answer is there, you may have to push to get it. What I am afraid of is that some of this will not be explained until the trial. What scares me even more is that Jacque will plea bargain and we may never have all the answers. You may want to ask also about the pictures. I think the answer is in them and I think that the rangers and DA know this. The only thing I don’t know is how they are being interpreted.
    We are all praying for a swift trial and for answers. Peace be with you and your family.

    I too sent a leter to the DA’s office as soon as I saw the link to it. If there is a confession I just don’t understand why there is not a murder charge. They need to refile the charges.

    As I have (bravely.LOL) mentioned previously, I work for CPS in Texas, and can explain why the DA chose the Injury to a Child charge instead of trying for a murder charge.
    In order to gain a conviction on a murder charge, the DA would have to prove, beyond a reasonable doubt, that the stupid bitch meant to kill the child (or engaged in conduct that she should have known WOULD kill the child). Considering that we are dealing with a stupid bitch…well, she would claim that she didn’t MEAN to kill the baby, she just meant to hurt her a little. After all, she’s just a stupid bitch, and couldn’t possibly have foreseeen, yadda, yadda. Sadly, I can assure you that there is an asshat defense attorney who will be all too happy to help her do it.
    If she claimed she just “lost it” and, being a stupid bitch, did something stupid…it is very, very possible that the best the jury would give would be manslaughter. That would suck in a HUGE way.
    Now here is the good part:
    In Texas, Injury to a Child can carry the same penalty as murder! WOOHOO!
    So…in order to combat the possiblity of getting the bitch a lighter Manslaughter sentence, he charges her with Injury to a Child, which sounds less heinous, but could get her dumb ass shut away for the rest of her sorry life.
    It’s actually a brilliant move. And it works. I’ve seen it happen.
    So, there is hope..just the fact that the DA was smart enough to do it is a good sign that there will be justice for this sweet baby.

    That would come out in the trial anyway. The only difference that the change of charge really provides is in the burden of proof that must be met by the prosecution. They still need “beyond a reasonable doubt”, but the need to prove intent is alleviated. It’s gonna be damned easy to prove she caused Injury to a Child..especially with the confession.
    Does that make sense? I’m not sure, cuz I’m way too tired to still be online..LOL
    I so agree with you about the family needing details and closure…and I’d be thrilled to see the so-called Mom’s but thrown under the jail!

    From what I am hearing from the family she has no remorse for what she did, maybe jail will bring out that remorse.

    I live in Decatur, TX and it totally disgusts me that Jana Jones has no more confidence in herself or the good people of Wise County than this! I think she should have gone for the muder charge and that the people on the jury would have returned a guilty verdict. It pisses me off that as a tax payer I am paying this bitches salary when she is obviously not capable of doing her damn job. At least we will have a new D.A. after the next election.

Dose anyone realize that TEXAS has more “criminals” released every year because it turns out they didn’t do it. That the legal system was WRONG and to lazy to do there job and actually look for the one who did it instead of the most convienant target. I am a friend of someone directly related to this horrible incident and would like to know why your grandchild doesn’t have a head stone. Why did it take the maternal side of the Taylor-Rae to offer to by one for you to even put the thought in your head.Considering that you bought your self carpet and a new flat screen T.V. and why she still doesn’t even have one? Is that not important to you?

    A bit of information for the uninformed. Jackie has cerebral palsy and can barely lift 10 pounds. How does one with CP throw a 40 pound child with such force as to cause that much harm? Look it up in your browser folks. See what CP does to the body and the brain. She is very much like a child herself. Now Ricky on the other hand, is a big burly guy with a temper. He manipulates and lies very well. And just so you know, Jackie’s “confession” showed up as a lie on the lie detector test. I would dearly love for the guilty party to be convicted. Not just any conviction will do. Some people are okay with anyone at all being punished for crimes, just so you can close the books.

    And as to JT taking care of his children all by his poor self, he has been living with his mommy and daddy for all but one year of his life. Even his 5 year old daughter knows how to cook for herself and wash her own cloths. Strange behaviour for a coddled, well taken care of 5 year old. And poor Taylor-Rae does not even have a headstone yet. After more than 4 months. But there was a gigantic TV and new carpeting installed the month after Taylor-Rae died. Kind of makes me wonder who really cares about Taylor-Rae and who just wants media attention.

    And one more thing, no one but the Baker family kept Ricky away from the funeral. Must have been what JT was laughing at when his daugher was being carried out in her casket during the service. I mean, what else could it have been?

    Welcome to the site. JBCB, who has posted above, is Taylor-Rae’s grandpa. Are you a family member, or a friend, of Jackie’s? If so, you and JBCB may know each other, so if you’re gonna comment on his TV or his carpet he may have a few words to add – just fair warning.

    The last email I got from Taylor-Rae’s grandpa was that the family was hopeful that Ricky would be indicted for murder if he was the one who actually killed Taylor-Rae, but the family would like to see Jackie charged with something a little stronger than “injury to a child”.

    They were in court with Jackie this week. Did you also happen to be there? If so, how do you feel about Jackie’s affect and behavior during court? The report I got said she didn’t seem too concerned about anything until her counsel whispered to her, and then she began to appear more upset. Your thoughts on that?

    Also so people know:

    The Maternal side of Taylor-Rae did offer to pay for the head stone which I believe the design had to be taken to a lawyer and later thier family was told that the paternal side would take care of it and that was about 3 weeks ago. Still no headstone. So why doesn’t everyone stop being childish and get that poor little girl a headstone. If niether side can afford it in full then why don’t they split the cost? Everyone seems so worried about her but if it was just about her and not trying to look like the “good guy” here then everyone would put thier petty crap behind them and take care of getting that poor baby a hea stone. Just an idea to consider!!!!!!!!!

    Thank you impqueen. Yes I am a family friend and have been for MANY MANY years. Attended Jackie and JT’s wedding along with being at the hospital when Triniti was born. Surprisingly JT’s family had to join us later from the lake along with his mom’s girlfriend! And before it’s brought up, yes, it was a scheduled inducing.

    We also understand that JBCB would have a few words to say but that doesn’t mean he’s telling the total truth. Jackie’s family had arranged for a headstone to be place, paying for it and JT’s family has blocked it. They informed the cemetry when asked 3 months ago if they had one already started, per him “No actually we haven’t done anything” That’s when they were informed that Jackie’s family was willing to pay for it ALL! and they placed it on hold! So the money wasn’t an issue until it was brought up in this forum.

    This family has manipulated everyone and is extremely good at it. I’ve seen it done. Jackie has lived it. They are ruthless and hateful and extremely spiteful. And yes JBCB, GOD does watch and he will see what you have done.

    As far as putting your son thru hell JBCB? JT allowed Jackie’s mom to take those girls to the park 3 weeks prior to this horrific event occured. You allowed the girls to come to family outting numerous times stating you needed a break! I’ve heard Taylor-Rae express numerous times she would like to live with her Nana or her Aunt Jess. You and your wife both sat at that hopsital that day telling Jackie’s mom and dad that you trusted them and knew that the girls loved coming to NANA’s house! Infact I believe your wife CHARLENE even stated they told you both and JT that they would rather go there than any other place. So you explain to everyone WHY you feel now they’re a threat to Triniti or how they’re dragging JT thru hell? I know for a fact that the only thing her family is trying to do is see Triniti! PERIOD! They’ve stated that the great grandmother would come to your house, sit in your living room under your supervision for 15 minutes if that’s what it takes. You’ve blocked the headstone, you’ve lied to people’s faces. YOU BLASTER THAT BABY’S FACE ON THE NEWS BEFORE YOU HAD A CHANCE TO EXPLAIN TO HER SISTER WHAT HAPPENED AND WHERE TAYLOR-RAE WAS. God only knows if she saw it. WHAT a horrible way to find out your sister was dead.

    And LAMBH! It’s nice to know that Rickey’s family is so two-faced. Nice to the faces, I’ve seen it. And then stabbing them in the back. YOU all thought it was JT’s family that did this!! Belinda had taken pictures of the bruising on the child SATURDAY the night before. The autopsy states she had brusing in her abdomin that was 48 to 5 days old. That does put her in that house. You state Rickey was the only one that volunteered for a polygraph. “why would a guilty man take it” I think your words were. Jackie volunteered.. and we were told by the Texas Ranger and the sherrif that the BOTH lied on the polygraph. Told by Belinda that Rickey failed his name. Told by the Texas Ranger no he didn’t but did fail just about everything. NONE of us were in that house and none of us know what happened. I did exaggerate the 10 lbs but Jackie does have Cerbral Palsy, has had it since birth. She wieghs 120 lbs, yet she was strong enough to throw that baby hard enough as to have injuries simialar to a CAR CRASH!

    I’ve watched Jackie’s family go thru a hell. IF Jackie did this, they know she should be punished! It’s the right thing to do, doesn’t make it easier for them to accept. Rickey’s family seriously needs to keep that in mind! He has three counts on him for Child Endangerment. Her family has lost not only Taylor-Rae but Jackie, Scarlet and Triniti. YES it may be at the hands of their own, but NONE of you know that pain and horrible time they’ve been going thru. THEY DID NOTHING WRONG BUT TO SUPPORT A CHILD THAT HASN’T BEEN CONVICT OR FOUND GUILTY OF. You all just read whats posted here and in the papers and on the news and takes it as the TRUTH! Makes me feel sorry that so many have such closed minds and can’t see anything other than what’s put in their face. They are trusting in God and he will deliver.

    Last thought, I don’t take faith in the fact that this might get thru to someone. That someone will say “wow, maybe what i’m being told or seeing, isn’t what it is”. Sheep generally go where they’re lead. IT’s easier and they can’t help it.

    Stop being petty and Get Taylor-Rae a headstone! After 4 months, THE BABY DESERVES IT!

    ALSO, JBCB! They had to make JT go to the funeral home to make arrangements after HE set the time up to be there! Told the Funeral director he was still in court. LIE. Then got there and stated they were late because they had to go to the cemetry! LIE! Her family is willing to PUT UP THE FU*KING MONEY! Y’all helt up the headstone being order! period!

    Let me add what I know. The carpet was supposed to be put down on the day Jaclyn killed Taylor-Rae. The television was a Christmas present. The box just recently got moved to the garbage. Which means that someone is keeping an eye on their house.

    Also, this crippling CP of Jaclyn’s. I have now been told by more than one person that her condition is well known, but that she has constantly used it to her advantage. She has been witnessed lifting things before. But I guess if I just slung my kid into a fireplace, and I had CP, it would REALLY start bothering me.

    I have also been informed that they are not allowed to see their grandchild because of CPS and nothing more.

    Now, I do not plan on playing middleman with this, but since one side of this equation does not want to sling shit with the other, they did want some things being said clarified. They also talked about the headstone and the funeral in general, but you know what? Who gives a fuck. JT and his family didn’t kill that girl and shouldn’t have to defend any of their actions. The one who killed that girl is sitting in jail for it.

    I’m glad you pointed these things out Morbid. You are absolutely right, J.T. and his family did NOT kill Taylor-Rae, so the rest to me is minuscule in comparison to what happened to this poor little girl. Let’s not forget that if it weren’t for Jackie and Rickie, there wouldn’t be a need to be buying a head stone for a 3 year old child in the first fucking place!

    I see that giant wall of words you wrote, but I didn’t see you answer my questions re: Jackie’s affect in court.

    I mean, she either killed her child or allowed it. Seriously. So in what way is that even remotely defensible? How is beating hell out of the victim’s paternal family going to change the fact that Jackie Pennington killed her child – or allowed it to happen and didn’t get her immediate medical attention?

    and, um, really, who gives a rat’s ass about the TV or the carpet – or, for that matter, the headstone? If Jackie and/or Ricky hadn’t beaten Taylor-Rae to death, the child would be alive and wouldn’t NEED a headstone.
