Taylor-Rae Baker Gets No Justice In Texas

Decatur, TX - I covered this case briefly back in February here, but at the time, I said something really stupid - or really telling. I said “Texas does not like babykillers unless you cut a deal.” Three months later, that’s exactly what’s happened.

On February 17, 2008, Jaclyn Pennington called 911 to report that her three-year-old daughter Taylor-Rae Baker wasn’t breathing. Taylor died later that day from internal bleeding and blunt-force trauma to the head. Why? Because Jaclyn Pennington threw Taylor into a brick fireplace - head first.

Taylor-Rae Lenette Baker lived with her father, J.T. Baker, her sister, Triniti Baker, and her paternal grandparents in Fort Worth. But the weekend of February 15, Taylor-Rae was on a visit with Pennington, her noncustodial mother, and Pennington’s husband Rickey.

Within two days, she was dead. Jaclyn Pennington later admitted to investigators that she lost her temper with Taylor-Rae and threw the toddler into the fireplace, cracking her skull. Taylor-Rae was beaten until her insides bled, and she died.

When Jaclyn Pennington was initially arrested eleven days after Taylor-Rae’s death, she was charged with capital murder and held on $1 million bail. To the Texas Rangers, it looked like an open and shut case. But when the Wise County District Attorney, Jana Jones, got the case, she sent it to a grand jury with a charge of “injury to a child”, which is how the grand jury returned the indictment. Murder wasn’t even an option for the grand jury, because DA Jones didn’t think she had enough evidence.

Um, a confession isn’t enough evidence? A dead baby isn’t enough evidence?

Apparently not. Thing is, Jones seems to think that possibly Rickey Pennington contributed or caused Taylor-Rae’s death. But she can’t prove that either, so Rickey Pennington is charged with “injury to a child” as well. “Injury” to a child who is now dead. The way this case has been handled, Jaclyn Pennington and her husband could be given a much lower bond and walk out of jail pending trial after her arraignment on the new lower charges.

Taylor-Rae’s father and paternal grandparents are angry. As should we all be. Texas was the last place I expected to see pull this kind of babykiller mollycoddling. I’m disgusted. There really is not going to be justice. Not for Taylor-Rae Baker.

    Across the state, 29 people have been exonerated with DNA since 1994.

    TWENTY NINE!! Oh my god - you guys are having a massive case of ineptitude by law enforcement and your judicial system!

    Texas has the second highest number of prisoners in the nation (just slightly below California)
    Texas has over 10% of the NATIONAL total of prisoners.
    It is third in per-capita prison population. (behind GA and LA)

    Given those facts - 29 is not all that big a number.
    (I know - in a perfect world it would be zero - but save that lecture for the “3 Things” category in the forum)

    29 people in Texas were innocent when they were executed.

    You say since 1994? That means more than 10 PERCENT of all people executed since 1994 were later exonerated by DNA?? Since the death penalty was re-instated in 1976, I think even the 29 you think is NOT A BIG DEAL is still an inaccurate figure, it is way too high

    But assuming you are correct………that is more than 10% of all TX death row executions and almost 1/3 of all executions of innocent prisoners in ALL states with the death penalty since 1976!

    If you still stand behind these figures and feel that they are simply acceptable losses, I can’t begin to fathom your way of thinking.

    It is actually worse for a state to prosecute someone so ineptly and then execute them so quickly, then to discover they were innocent than many of the cases posted on here. Many of the posts here relate to crazy/drunk/under the influence, etc nut cases “snapping”

    A state judicial system HAS to be held to a much, MUCH higher standard!

    Let me being by saying that JBCB and that family are not the only ones who lost a child. This list of victims in this horible crime runs long. The maternal family has been made to look like, and i quote from JBCB “Evil” people. Why would he think them evil? They have done nothing wrong in any way. This family who has suffered more than anyone could imagine. And just to clarify, at no time has CPS submitted any paperwork keeping the maternal family away from Triniti. There would have been a court record and documents given to the paternal family, if this was true. Visitation is fine with CPS or they would have put it in writing otherwise. It’s like the law. Duh

    Lies are predominant in this entire forum. It nausiates me actually. And the vultures who read this crap swallow it like mama milk. Feeding off the hate.

    And how do you “play off” CP? You either have it or you don’t. Jackie has had several operations on her since birth. You can’t fake that. Why would you even try to down play her condition? But heartless people do things like that. I don’t understand it and am glad for it.

    So all you guys want to tear down all family and friends associated with Jackie. Feel free if it gives you a rise. We will rise above the scum. Jackie will be acquitted. Of this I feel confident. The guilty party will be punished. If not by the courst than by God. We all have to account for what we do in life, at death.

    If only guilty people were arrested, we would not have courts. cops will predominately take the easy way out and let the courts do the rest. And God knows the truth. He has my full and unbridled faith.

    TAYLOR-RAE NEEDS A HEADSTONE. JBCB NEEDS TO ALLOW IT. IT HAS BEEN TOO LONG ALREADY.

    It’s always the same isn’t it? I would be glad to give anyone a chance to state their innocence if they could back it up with more than personal emotional feelings and hearsay.

    I’m hearing a lot of “poor Jackie, poor Jackie”, and no “poor Taylor-Rae who didn’t deserve to NEED a headstone at the age of three”. But i guess it’s more important that she get the headstone than it is to be mad at the people who killed her, huh?

    Keep in mind that even IF Jackie didn’t do it, she let her husband abuse that baby. And even IF Ricky didn’t do it, he let his wife. One of the two of them is the person who killed Taylor-Rae. One did it, the other let it happen and didn’t report it. This doesn’t sound like “innocent” to me, it just sounds like two slightly different degrees of horrid, babykilling scum.

    Is this an example of not being able to see the forest through the trees? I love when these folks come on and are so consumed with “proving” that their friend or family member only witnessed the abuse that they fail to note that it doesn’t fucking matter.

    I think it is funny how this family can say they stand up for Jackie and that she did nothing wrong. but yet they can’t or won’t show their faces for support in court. But yet JT and our family hve been to every court hearing to be here for tay tay. This last time we went she was so upset with what has happen to her baby that she was talking and showing pics to a sex offender. I can only hope it wasn’t of the girls. sounds pretty upset doesn’t it. And we never said that it was just her we believe that there was alot of people that knew what was going on. But we will see when it is all saiid and done. The wheels of justice trun slow, but better to be slow than to let ANYONE that is responesable for this get off free.
