New Bedford, MA - You know, I’m never gonna understand what makes a guy wake up one day and think, “Hey, you know what would be fun? I’m gonna go get that mentally retarded guy and take him over to the guys, and then we’ll gang-rape him. And then we’ll all threaten to kill him and his family if they tell anyone.”
But Buddy E. Smith, 22, has thought that at least twelve times since 2004. That’s right, TWELVE. And his friends? They like to help. The unidentified victim was so terrorized he had to move away from his family and out of town. And still, Buddy Smith kept coming after him.
The whole thing allegedly started in 2004 when Buddy Smith met the victim through a mutual friend. Soon afterward, Smith began to sexually assault the young man when they were alone. The victim is classified as mentally retarded/developmentally disabled. Smith would threaten the victim to keep him quiet, and tell him to comply or his family would be hurt.
Smith later took the victim to a church parking lot in Fall River, where Buddy and several other men sexually assaulted the victim as a group. Smith then took the victim home, but the gang rapes continued through 2005 under threats of violence. One regular participant was identified as William Senay, 52, Buddy Smith’s uncle. Stalking the victim became routine. The victim’s family began noticing disturbing changes in the victim’s behavior, and became suspicious of sexual abuse.
In January of 2006, Buddy Smith showed up at the victim’s home, but the victim’s mother answered the door and got suspicious of Smith’s story and her son’s behavior. The police were notified, but initially may have refused to take a report. The victim’s family then took him to a hospital, where it was determined that he had been raped.
Buddy Smith was indicted six months later, in June 2006. He was arrested on charges of rape, indecent assault and battery on a retarded person and witness intimidation. William Senay was charged at the same time with rape and indecent assault and battery on a retarded person. None of the other suspects have yet been located, and I have to wonder how hard police are looking for them. Both Smith and Senay are set for trial starting July 21, 2008. That’s two years from indictment to set trial.
As if the wheels of justice don’t turn slowly enough, Smith made his $1,000 bail and immediately started stalking the victim again, even though a specific condition of bail was that he not contact the victim. Smith would send his friends by the victim’s house in various cars to “remind” the man they were watching him, and would threaten family members who tried to intervene. Eventually, the victim was moved out of town several times to help him stay safe. But even that didn’t work, and last December, Smith found the man and took him out to be gang-raped and brutalized yet again.
The victim, terrorized, was afraid to talk. But on March 20, 2008, Smith was caught sitting outside the victim’s group home in Rhode Island, trying to see inside a large window. Why it takes six weeks to decide whether a suspect is violating terms of his bond I have no clue, but it kind of seems like nothing’s really gone right for this victim. Finally, Buddy Smith was arrested again on Tuesday, May 6.
Bristol County Assistant District Attorney Steven Gagne argued in Superior Court on Tuesday that Buddy Smith “..poses an immediate threat to the victim. This threat needs to be addressed today.”
Sounds to me like Buddy Smith’s threat should have been addressed about four years ago.
Buddy E. Smith is being “temporarily detained” pending a May 21 bond revocation hearing in Bristol County. Both Smith and William Senay are scheduled for trial on July 21. Hopefully a jury will give this victim justice, because he sure hasn’t gotten any so far.

Buddy should be beaten in the head enough times with a baseball bat to be rendered mentally retarded/developmentally disabled so he feels just as helpless as his victim felt. Then he should be gang raped in prison everyday for his natural life, with guards and prisoners not involved in the rape ignoring his screams. He should be put through everyday what he put his victim through. Though drawn and quartered would also work and may be a more appropriate punishment, especially if being on the receiving end of a gang rape would get this POS off.

BUT everyone who is responsible for this situation being allowed to continue has to be held responsible for it. If a pretty young girl was stalked and repeatedly raped by a group of men, and LE did nothing much, this would be getting the lead story on every single news station and front page of every newspaper. The public would be calling for the PD’s heads on a stake. I don’t know this man’s level of disability, but he was disabled, and if it had been a child (instead of a child’s mind inside of a man’s body), no one at that police department would have a job left.

Their son was treated sub -human by LE and the mother fought back until we thought she’d drop from exhaustion. They definitely reported it and the police did nothing until a forensic examination came in . From there it was running and backpeddling by LE. Her sons both have a very rare syndrome with more than MR there are physical features apparent in this syndrome. As a county, we are outraged by the bail to begin with. The mother is a nurse and 1 guess to where she worked while being stalked by this animal??? check out his other myspace number 134357072 He names his space the place of her previous employer until she couldn’t take it anymore. He would describe her every move or the boys every move- like moving to a new place, or sleeping, everything you can ever imagine.The mother has described him stalking in a red sox cap in testimony. Notice the redsox symbols everywhere. She just went to court herself to get a restraining order in January or february. Who would have to do this when there is a 3-4 feloney indictment. Imagine she had to pay a civil court for more protection. You can’t imagine what this family has been through. This guy is completely evil and so are his cohorts, who have been identified but never indicted. The mother does not resemble who she was 4 short years ago. Her son has been stolen from her in every way possible. My heart breaks for her son to no end.

By professional accounts this victim never should have reached his teens but through the dedication and persistence of care given by his mother he thrived despite the odds. All of this so that this psychopath Buddy Smith and his gang of crap-bags could manage to devestate this family beyond repair. Throughout this entire ordeal the mother has attempted to keep her children safe by adding fencing, a surveillance camera, special locks in her home, removing her landline, and provided constant supervision with the dayprogram and family supervision. DESPITE these efforts Buddy Smith continued to relentlessly stalk and torment this victim and his family further violating him and necessitating this victim being taken from his home to a 24 hr supervised housing many miles away. The mother who devoted herself to the survival and protection of her children can now no longer share in her son’s daily life. Even THIS was not enough to keep him safe! Buddy Smith managed to locate the victim in this remote town, can his motivation be anything other than nefarious!? This victim is uprooted once again and moved in a disguise for his protection. The family could not visit until everyone figured out how to manage this without the possibility of being followed and compromising the victim’s location. The young man was heartbbroken because he planned a special birthday surprise for his mom and he couldn’t follow through with it. He cries to come home and his mother has to leave him behind solely for his protection. These people have been in prison all this time!! Finally, when Judge Nickerson held Smith pending the full hearing for bail revocation, the mother was able to sleep for more than 4 hrs for the first time in 3 years! My hope is that the DA’s office continues to put the effort that was displayed at the bail revocation hearing and gets the justice and protection this family deserves.

LE should be reamed to high hell. They always hollor, “let the cops handle it”, “do things the right way”, or “you have to be legal” — well, here is a shining example of why people DO take things into her own hands!! They are left no choice!!
My heart and prayers go out to the victim, most certainly. I’m also saddened for the mother who struggled so much to help her son have a quality life, only for these POS to come along. I have to commend her for her continued efforts to protect her son “legally”. I know that she basically has to take this shit - because if she didn’t her son would not have her to look out for his well being.
His mother, had she took the POS out, as I more than likely would have, would be in jail. I bet LE would have got off their sorry asses to arrest her had she shot Buddy in the balls, which he deserved. She would have been just like Teresa Baker, in jail for protecting her child because LE would not act to protect them. Ms Baker and her daughter were poor and the abusing bastard was reportedly a magistrate’s grandson. So they were not worth LE’s time to protect them. This poor boy was disabled, so the law just turned a blind eye to them. LE sucks!
I did write the Mayor of Huntington, WV on Ms Baker’s behalf. I would be more than happy to write to the leaders of this town, if either of you would like to post some names and addresses or e-mail address. In fact, I would love the opportunity to speak up for the victim and his mother. LE can not come up with any excuse that should be accepted by anyone - unless they just want to say we are sorry bastards who didn’t do our jobs. Now, that I would accept and believe.

May 11, 2008 at 2:03 pm -I am almost embarrassed to admit this…however I knew and hung out with Buddy Smith a couple of times a few years ago as he had dated a male friend of mine. (His myspace status is “straight” however he is gay or at the very least bi). I do recall him mentioning that he lived with his uncle (which happens to be the uncle who helped him take part in gangbanging the victim). Sick bastard. And believe me..I never suspected him of being capable of doing such sick things that was mentioned in that article. The Buddy I remember was a funny guy who loved to sing and was looking forward to his 21st birthday (at the time I believe he was either 19 or 20) and getting a car (at the time I knew him..he didnt have a vehicle, just a drivers license). However, he wasnt the greatest smelling guy in the world so one time me and my friend decided to leave him stranded in a McDonalds parking lot and took off. My friend didnt date him for long so I never hung out with him after that and instead would only see him in passing (like at the bank, mall, etc.) The mere thought of knowing that this kid (Buddy) was a friend of mine practically sickens me. You really just never know about people nowadays. Sometimes I wonder if his uncle (William Senay) did anything to him growing up as a kid, but its still no excuse for him to stalk and rape a mentally retarded person because of it. In my opinion its just as bad as if it were a young child. Young, old, mentally retarded, or not, nobody deserves to go through what that poor victim endured. I hope for the sake of the victim (and his family) that justice is served. Somehow the idea of him (Buddy) being in jail isnt a good enough punishment because it would be like letting the fox loose in the hen house seeing how he is either gay/bi anyway. He should get tortured.
