New Bedford, MA – You know, I’m never gonna understand what makes a guy wake up one day and think, “Hey, you know what would be fun? I’m gonna go get that mentally retarded guy and take him over to the guys, and then we’ll gang-rape him. And then we’ll all threaten to kill him and his family if they tell anyone.”
But Buddy E. Smith, 22, has thought that at least twelve times since 2004. That’s right, TWELVETwelve reviews
. And his friends? They like to help. The unidentified victim was so terrorized he had to move away from his family and out of town. And still, BuddyBUDDY
 Smith kept coming after him.
The whole thing allegedly started in 2004 when Buddy Smith met the victim through a mutual friend. Soon afterward, Smith began to sexually assault the young man when they were alone. The victim is classified as mentally retarded/developmentally disabled. Smith would threaten the victim to keep him quiet, and tell him to comply or his family would be hurt.
Smith later took the victim to a church parking lot in Fall River, where Buddy and several other men sexually assaulted the victim as a group. Smith then took the victim home, but the gang rapes continued through 2005 under threats of violence.  One regular participant was identified as William Senay, 52, Buddy Smith’s uncle.  Stalking the victim became routine. The victim’s family began noticing disturbing changes in the victim’s behavior, and became suspicious of sexual abuse.
In January of 2006, Buddy Smith showed up at the victim’s home, but the victim’s mother answered the door and got suspicious of Smith’s story and her son’s behavior. The police were notified, but initially may have refused to take a report. The victim’s family then took him to a hospital, where it was determined that he had been raped.
Buddy Smith was indicted six months later, in June 2006. He was arrested on charges of rape, indecent assault and battery on a retarded person and witness intimidation. William Senay was charged at the same time with rape and indecent assault and battery on a retarded person. None of the other suspects have yet been located, and I have to wonder how hard police are looking for them.   Both Smith and Senay are set for trial starting July 21, 2008. That’s two years from indictment to set trial.
As if the wheels of justice don’t turn slowly enough, Smith made his $1,000 bail and immediately started stalking the victim again, even though a specific condition of bail was that he not contact the victim.  Smith would send his friends by the victim’s house in various cars to “remind” the man they were watching him, and would threaten family members who tried to intervene. Eventually, the victim was moved out of town several times to help him stay safe. But even that didn’t work, and last December, Smith found the man and took him out to be gang-raped and brutalized yet again.

20, 2008, Smith was caught sitting outside the victim’s group home in Rhode Island, trying to see inside a large window. Why it takes six weeks to decide whether a suspect is violating terms of his bond I have no clue, but it kind of seems like nothing’s really gone right for this victim. Finally, Buddy Smith was arrested again on Tuesday, May 6.
Bristol County Assistant District Attorney Steven Gagne argued in Superior Court on Tuesday that Buddy Smith “..poses an immediate threat to the victim. This threat needs to be addressed today.”
Sounds to me like Buddy Smith’s threat should have been addressed about four years ago.
Buddy E. Smith is being “temporarily detained” pending a May 21 bond revocation hearing in Bristol County. Both Smith and William Senay are scheduled for trial on July 21. Hopefully a jury will give this victim justice, because he sure hasn’t gotten any so far.
