Jason M. Eberhardt Doesn’t Follow Directions

Marlbough, Mass. - You know those guys who never listen? Yeah, Jason Eberhardt is one of those guys. He was in court on Thursday to be arraigned on a charge of raping a seven-year-old. Despite the prosecutor’s request for a $10,000 cash bond, Judge Jonathan Brant decided to let Eberhardt just walk out of the courtroom – as long as he followed some simple instructions, like “don’t contact the victim.” So Eberhardt, 32, walked out of the courtroom and went to a pay phone, where he called the victim’s house. Twice.
The first time Eberhardt called the child’s home, he hung up. But then he called back and pretended to be a “Detective Brady” of the Marlborough Police Department. Except that there is no Detective Brady at the Marlborough Police Department. The victim called the cops and gave them the caller ID number, which was traced to a pay phone outside a sandwich shop. When police got to the sandwich shop, there was Jason Eberhardt.

hearing in front of Judge Andrew D’Angelo. Judge D’Angelo didn’t buy defense claims that Eberhardt was “just trying to get numbers off his cell phone that was left at the residence”, and ordered Eberhardt held without bail for a minimum of 90 days.
As Judge D’Angelo put it, “He has violated a special condition of release and I do not believe any conditions can assure the safety of the alleged victim or the community.” After the 90 days is up, Eberhardt’s bail will be set at $10,000 cash.
Jason Eberhardt’s Myspace page looks pretty normal, although there are pictures of him with children – in particular, a little girl who looks like she could be the victim in this case. He appears to be engaged to a woman named Stephanie – a woman who has children of her own. As recently as April 29, he was commenting on her MyspaceMySpace
page about moving to Florida, and how he plans to marry her.
Eberhardt has a history of legal issues. He has outstanding drug charges in California, and has at least one abuse protection order in Massachusetts. Just a few weeks ago, he was arrested on bench warrants and charged with driving on a suspended license.
The rape of the seven-year-old victim allegedly occurred on Christmas Eve, 2007. The charge in that case is statutory rape of a child, but the DA’s office says that the charge does not imply consent on the part of the victim. Due to the nature of that crime and the child’s age, no information is being released on the case. However, based on the date and on the fact that Eberhardt is a divorced father, it appears that the alleged victim may be Eberhardt’s own child.
Jason M. Eberhardt will be spending his time in the Marlborough Jail, awaiting his next court hearing on May 29. And maybe Marlborough voters will think again about re-electing judges who let accused child molesters walk out of court. If molesters can’t control themselves enough to keep their dicks off children, how are they supposed to be out of jail with only a set of behavioral suggestions to keep them in line?
