Apr 10, 2008 at 4:01 pm -Pooh - Being charged as an adult just means she’ll be subject to adult sentencing guidelines. She’ll be housed in a juvenile detention facility until she’s of age, at which point, she’ll be transferred to big people prison.
In other words, if the maximum sentence for an adult for the charge of aggravated assault is 15 years but would only be seven years for a juvenile, this girl would be subject to the 15 year maximum sentence, rather than the seven year maximum sentence normally dealt to kids her age. Juvenile court typically carries with it more lenient sentencing guidelines. Sentencing kids as adults simply gives them the option to incarcerated them longer.
It’s a common misconception. But, no, they aren’t going to throw a 14 year old in with adult women.

This was an ass kicking - none of the girls are going to do that much time. Hell, we can’t get admitted baby rapers or murderers more than a few years - why would anyone think these girls “are gone” for a long time?
1-2 years in adult prison could completely change a 14 year old for the worse not better and she will be getting out. She is not going to be a lifer or anything close, so why ruin her more than she is?
I have officially quit waffling. While it may not be the popular opinion, I have officially sided, with myself, that she should not be tried like the other girls. Let the bashing begin.
Thanks solange, your post stopped the waffle, honestly. I thought about your statement of “If she’s this bad at 14, imagine when she gets older?” I know a girl who killed a man in a car wreck. She went to adult jail - I’ve heard her stories. I can’t put a 14 year old child in there where she was. I just couldn’t, especially not for giving someone an ass kicking - something I have gave and received many times, myself.
Where is Michelle on this one? I’d really like to hear your thoughts on this, since we have had a “few altercations” - do you feel the same? She is cowardly - YES. She did something that neither of us would have done - we would have waited for a chance at the Lindsey girl, by ourselves. But it was just fist fighting. No one, picked up anything as a weapon. No one died. She got her ass kicked - she’ll live to repay the favor.

Damn, Athena, I had just sided with myself, too. Here I go waffling. If it only means her actual punishment can be extended, then yes, I am more willing for her to be tried as an adult. But then I consider, your statement about “the age of consent laws” and that puts it in a whole other catagory for me to consider.
Just call me the waffler, I suppose. Now I’m on the legal side of it and not what is best for the child. I have to consider what other teens may do in the future and what part the “age of consent laws” will be affected or ignored or just useless. You were dead on in your statement about there needing to be “consistency” when applying these laws.

She will still be in juvi, and let’s face it, like Pooh said, they probably won’t be there that long anyway. I understand that a young girl that age can succumb to peer pressure, but oh well. You do the crime, you do the time. Maybe now she’ll learn to use her head and not be so easily influenced. Amongst all this consideration for what prison will do to these girls, let’s not forget about what all this has done to the actual victim. Fights happen often, but I dont consider this planned out attack, with the video-taping, etc. to be normal teenage rebellious behavior. Even with the majority of fights and jumpings that you hear about, most of those people have the option to RUN AWAY. The fact that they literally trapped this girl in the home (who wants to bet that those boys werent just looking out for anyone coming, but to make sure no one LEFT as well?) speaks volumes to me. That is a hard crime, and therefore these bitches deserve some hard time.

I hope all these folks get exceptional sentences. But if that’s the case and we’re going to jump on the sentence-as-adults bandwagon, perhaps we should reconsider the logic behind other age of consent laws.

And, like I said, since it only means they can extend her sentence but not house her with adults, I am much more willing to try her as an adult. She definitely needs to learn a good, hard lesson about her actions.
Athena voiced some good points about the law. Now, I’m considering the next 14 year old that messes up - planned or not. A lot of time and effort went into creating the current juvenile system. And while it needs to be revamped, it is not a useless system and was created for a good reason. Given what Athena put out for an arguement, I have to consider the next case and the next child - since we’re talking legal now.

I myself was sent to Army bootcamp, it saved me.
A 14 year old in jail is kinda scary, really it is. If you have ever even been in even county lock-up its FUCKED UP and SCARY!
I wish no harm on this misguided young lady but I have to tell you. I am an advocant of tuff love and bootcamp,it saved me. Really! I believe the judge should look at eachof these girls and make a decison from there. My instincts tells me, at a minimum each should have to endure bootcamp or an equivalent.
I was an arrogant, bitch of a person at one time and could imagine I had the same frame of mind… Fuck them I would do it again!!
I have to say, in retrospect, if girl had not been so submissive, she might have ended up dead.
So, in reference to the girl, and all the others, the punishment MUSt be hard, if its not its like a slap on the hand that says “go ahead do what you want, yo can get away with it! You’re so cute…

It may vary from one state to another, but I know that in California and Washington, you must petition for juvenile court records to be sealed and that petition must be approved by the court. They are not automatically sealed and the court has the power to deny the petition.
Also, in Three Strikes states, particularly serious or violent juvenile offenses can count as a strike, even if the records are sealed.

He is no longer licensed in any state. He was licensed in Texas, but there is a matter of an “innapropriate relationship” with a 19-year-old patient (he says he was employing her as a secretary, she says he was fucking her, either way, any first year psych student knows those are both no-no’s) that drove him out of private practice and into the business of using psychology to win court cases for rich clients, such as Oprah. And now we have the asshole on TV and bailing little bitches out of jail when they should rot there. Thank you very fucking much Oprah.

I’ve heard several people say, though, that Oprah is in the habit of promoting certain people on her show, and that when she does, they invariably become ‘famous’ in their own right. It’s amazing how mom treats the girl like a poor innocent baby, crying and coddling her. I feel kind of bad for the mom, but damn, dont let love get in the way from teaching your child right from wrong. Your daughter deserves some discipline, trust me, when she becomes a responsible adult she will thank you for it.
