Did Tyson Chamberlain Kill Easton Lee?

On Friday night, MarchMarch reviewsMarch reviews 21, Tyson Chamberlain and his girlfriend Chalice Rutherford were taking care of eight-month-old Easton Lee while his mother, Heather Kern, was out for the night. Kern, Chamberlain and Rutherford all lived in the same north Phoenix home. According to Chamberlain and Rutherford, they put baby Easton to bed about 10:00 p.m., but he woke up vomiting a few hours later. By 3:00 a.m. on SaturdaySaturday reviewsSaturday reviews, March 22, Easton Matthew Lee was dead.

Easton Matthew Lee was born on June 21, 2007, the son of Heather Kern and Robert Lee. His extended family keeps in touch via MyspaceMySpaceMySpace, so there are pictures of baby Easton and his pretty blonde mother all over the internet. Easton appears to have been a very tiny newborn who grew quickly into an average-sized, smiling baby in a large, supportive family.

Tyson Chamberlain, 30, and Chalice Rutherford, 24, are parents themselves. Their Myspaces show lots of pictures of their toddler daughter Keiarra and more than one lingerie shot of Chalice. A civil suit for back rent filed last SeptemberSeptember reviewsSeptember reviews shows why they may have needed a roommate. And while Chalice seems to have a number of friends, Tyson Chamberlain has only a few.

Chamberlain and Rutherford called 911 about 3:00 a.m. last Saturday morning to report that Easton wasn’t breathing. Chamberlain’s story was that Easton had somehow slid under the water during his bath, and any bruises must have come from the CPR that Chamberlain performed, trying to revive the infant.  The problem with that story became clear on autopsy.  Easton Lee had blunt force trauma to both the head and the abdomen, resulting in skull fractures and a damaged colon. He also had a number of bruises and abrasions.  His hair had been ripped out of his scalp.

Then there’s the picture of little Easton taken on March 14, the week before his death. I found it on a relative’s Myspace. In it, Easton is being held by an aunt – and has clear injuries to his face:

Is that normal “baby fall-down” bruising? Possibly. But the timing is frightening. How often did Chamberlain and Rutherford babysit? How did the bruised eye and nose abrasions happen? Maybe it’s nothing. Or maybe last weekend wasn’t the first time Easton Lee got hit.

According to their Myspaces, Robert Lee’s family believes that Easton was murdered. I’m not finding much on Heather Kern or Robert Lee themselves (her Myspace is set to private), but they weren’t home when Easton died. That pretty much leaves Tyson Chamberlain and Chalice Rutherford, and Chalice hasn’t been charged.

Tyson Chamberlain was arrested on Wednesday and charged with first-degree murder and child abuse. He is being held in custody in Phoenix, and bail has not yet been set.

    Oh! For those that can't get to the PDF file, Tyson Chamberlains attorney asked that he be released OR until sentencing and that was granted with conditions, he is to have NO contact with children, drug monitoring(wonder why?) and standard release conditions. He must be in court on February 10, 2010 to hear victims family statements and then of course sentencing on the February 11, 2010.

    Tyson defenders are a bunch of liars or believe Tysons lies, Anyway, Tyson pleaded guilty to negligent homicide and I am sure Easton Lees family were consulted before the plea agreement came about. Obviously he killed Easton, but it was reduced to a Class 4 Felony.
    I am so very sorry, Easton Lee, you have been in heaven almost two years and justice still has not been served, it doesn't appear that it will be, unless Corys buddies get to Tyson when he goes to prison.

    Chamberlain could receive a sentence of three years to six years.

    The wheels are turning slowly, but I still hope that there will be some form of justice served for Easton. Whether it is through the courts or GP in prison.

    Just trying to give an update to the ones have shown us support from the very beginning... had a court date today, didn't expect to see Tyson since we were told he did not want to be transported and would not be there. I really can not wait for all this to be over, even know we know our lives will never be the same without my Easton, I miss him everyday. It is the little things you miss the most. While out watering my lawn the other day I told my hubby, you know, Easton would have been 2 next month, OMG I cant believe my little grandbaby would be 2 already. He would be coming over to grandma's house and saying "grandma"!! I never even got to hear those words!! I will never forget him and I hope (even though it hasn't been because of good) I dont want anyone to forget him!! I miss him everyday!! Court days like today only always bring it to the forfront!! We were told that Tyson would not be at court today because he "waived his right " because he did not want to be transported. He was there & his evil stares and look still haunt us,,,,,,,,,,,,, next court date is July 10. Thanks to everyone who has supported us, we will forever be grateful,,,,,I just hope that no one has to live thru what we have had to endure!!

    Holy Shit! Holy Shit! I have tried to keep up with this while having a VERY busy work schedule. Pot smoke in baby's face, violent dad (with a record) on the record, coward mom on the record, bloody flip flop attacks, CPR gone bad, bad grammar and spelling, drowning babies with hair pulled out. Fuck, babies being saved on pool sides, past rent debts, cat burglars, bruised and abraised kids just put to bed, 3 computers running to save a Frakenstein, Tyson being touched in corners, lie detectors, and oh SHIT GOD JUDGING!     I hate to be a bitch - well, not really, but I usually refrain from commenting on writing errors unless it is a GLARING error (meaning numerous times in a long post), and the person writing absolutely sounds like a complete idiot. You have only one of these going for you (errors), but I have read enough of your posts that it is beginning to bug me.

    Please learn the proper use of capital letters, as well as commas and other punctuation. It would also help if you could check words you may not be sure of for spelling mistakes. A dictionary would help with that. Also, if you could brush up on the more common synonyms (there, their, they're), it would be helpful.

    'There' indicates a place.
    'Their' indicates ownership of something (belonging to them)
    'They're' is a contraction meaning 'they are'
    Example sentence: "They're going over there to pick up their child." It means: "They are going over to that place to pick up the child belonging to them."

    Other frequently misused synonyms on this site are: 'then/than', 'are/our', 'know/no', and 'here/hear'. I'm not sure if you have misused all of these or not, but it wouldn't hurt for you to brush up on them anyway.

    And before you get all pissy about the fact that you may be overly excited by this discussion, let me remind you that you CAN proofread your posts before hitting the 'submit' button. I do. It takes a little longer to get the post to the story, and sometimes, I get 'scooped' by someone who may be a faster (and better) typist than I am; but at least I don't have to harbor feelings of guilt over whether I brought on a migraine, or caused partial blindness to another commenter by forcing them to read poorly edited comments.

    My OPINIONS may very well make some of the others here sick - but never my grammar and technical skills. Except for the first few comments I ever left, which I failed to separate into proper paragraph form. Even then, though, it only took one person telling me about my error to induce me to remedy the problem. Would you be so kind as well, please?

    OK, Y'all know that I'm the last one to defend an assmunch, and usually the first one to be hateful to them (if I can get in line fast enough). I even already said some hateful stuff about this guy, already! ;-) That said, I wanted to give a few new opinions, having read the latest posts here. I'm not saying that I'm right, or even that I believe this is what happened in this case, just postulating.....

    Maybe they really do know that Chamberlain is innocent, and are trotting out this arrest story in order to keep him in protective custody until they can arrest the father. It's been known to happen if a particularly violent person is suspected, but there is not enough evidence to charge him with; usually it is done to keep the violent suspect from fleeing, by making him feel 'safe' because an arrest has already been made. And the father of Easton WAS known to be violent.

    Since when do you yank a baby out of the tub by his hair? Their bodies are small and they are easily scooped up. That baby was abused.

    To Unamused Cat and Imp, who made a similar query: It is entirely possible that this is the case. The account never said he left the room, only 'reached for a towel', I thought. If he turned his back for a second, and turned back to get the baby, and the baby was underwater, he might have grabbed for the nearest handle to the surface (which would be the hair, since it is lightest, and floats) - I DID. Yes, I said, "I did!"

    Last year, I was at a hotel with my five youngest children, and I was changing the baby's diaper on a lounge chair beside the pool. He was 13 months old, and My next oldest was 3. I had the 3-yr old beside me, and was not going to let her back in the water until I could go back in with her. Did you know that 3-yr olds are slippery little suckers when wet - and quick as greased cat shit? The darling angel ducked under me while I was reaching for the clean diaper, and sprinted to the DEEP end of the pool, and took a flying leap as far as she could into the water.

    I jumped up, with a diaperless baby boy (thing swingin') in my arms, and ran to the edge of the pool. I realized before I got there that I could neither put him down to get her (or I would most likely wind up with two floating), nor could I jump in with him, keep both of us above water, and still get her. I did the only thing that I could. The only part I could reach was her head, which was under water, and only then by prostrating myself on the side of the pool, with my entire torso hanging over the edge. I tucked the baby under my legs, to hold him down, and reached across the water to grab a handful of hair. I lifted her STRAIGHT UP out of the water, and then pulled her to the side of the pool (still by her hair). At that point, I was able to use my other arm (that I had been using to keep me from falling in the water), to push myself into a sitting position, and then grabbed her by the arms to lift her out.

    I did it without thinking - the entire process from jump to holding her in my arms on the side of the pool probably took less than ten seconds. Maybe less than five. And I noticed, after making sure she was OK, and checking her for any other signs of trauma, that I had several of her hairs in my hand, and on my chest, where I had held her as soon as I got her out. Not enough to make her scalp bleed, but enough to make a red patch that prevented my brushing her hair very well for a few days. We used a lot of cloth headbands for the rest of the week. So, it is entirely possible that the bathroom scene unfolded just the way he claimed.

    As to why the baby was being bathed at 3 AM, the baby had reportedly thrown up, which is another indicator of previous head trauma. It can take SEVERAL HOURS for nausea to occur after a head injury - not always, but often enough that a doctor will tell you to keep a very close watch on your child for at least 24 hours after a head injury, to be sure there is no concussion.
    And returning from wherever to see a child underwater, why would your first response be to pull him out by his hair? That’s just weird. ...... that’s some crappy babysitting and death by neglect if not by abuse.


    I know that you also mentioned that 'that baby didn't drown', Imp. Neither did my daughter. No water in her lungs, she was only under for ten seconds, at most. But long enough to scare me badly enough to take the measures I did to save her. Did I mention that my baby son also wound up with a couple of scratches on his leg, because I pinned him to the concrete with my legs in order to get my daughter? And he squirmed, causing a couple of minor scratches. But in addition to grabbing her hair BEING MY FIRST REACTION, it was also my only option.

    And, I know that you have never met me, and all you know is what you've heard from me, but assuming that everything I've told y'all about myself is true (and it is, just for the record), would you have called ME a crappy or neglectful parent in that situation? It was a case of not enough arms to do everything at once. But it wasn't neglect or abuse, or crappy parenting. At least, I hope you don't think that about me ;-) Love ya Imp!

    I know I said earlier that Chamberlain won, but in light of my utter confusion at this point, I am not certain who won, anymore. But I do know that Easton lost. Which is a tragedy. And whoever is proved to be the ACTUAL winner in that game needs to be made a player in the 'jailhouse bitches' game, after being convicted.

    And just so no one is confused, or forgets what I said in the first paragraph of this statement: I am not saying any of this is true, or likely, or that I believe it or that I don't. I am just theorizing, for the sake of something interesting to do until bath time; when I can dunk each of my children repeatedly under the water, just to have a good reason to snatch them all baldheaded! :-D *snicker, snicker*

    Could be that she beat the baby then handed it off to this couple to watch, to get them in trouble for the injuries she caused.

    Something just don't add up right in this case if the baby has marks on him in the last picture Imp posted.

    In reading the MS profile of the baby's dad Robert it says he is no longer with the mother because he fucked up & that he was in jail for 5 years. I wonder if the Mom or Dad could have abused the baby? The baby does have bruises or marks 1 week before he was babysat by these two.

    Looking at all the pics of Tyson's daughter she is smiling & looks happy. I didn't see any bruises. It's completely possible that he did kill that baby but it just seems like we are missing a piece to the puzzle.

    No matter what this is such a sad ending. My son was born July 20th so it really hits home. I can't imagine anyone hurting such an innocent baby.

    I agree with nurseronda and mommyto3 and enb01. This doesn't add up. Mom and dad were fighting, baby got hurt, left the baby at home where he lived and Tyson paid for it. After all he did say he thought it drown, don't you think he would have come up with a better excuse, like geez I must have accidentally dropped him? Why aren't the parents all over the news for the suffering they are feeling? Let's see how this unfolds. I feel for all involved, but especially the pain that baby went through.

    anyone who knows tyson is 100% w/ no doubt at all he is not guilty tyson character is a laid back guy with the biggest heart. tyson has been more of parent then those baby Easton ,opened his home,bought food,diapers,gifts,his crib,free child care and loved baby Easton. the parents were in a bloody fight that same night w/the baby in thier arms,please check out the violent history of the father Robert Lee.WHY WASNT THE PARENTS QUESTIONED W/THEIR VIOLENT HISTORY? Tyson has no record?Was he framed?

    JHJ3, what are you suggesting happened? That the parents did something to Easton before he was with Tyson and Chalice? Wouldn't they have noticed and gotten help for him immediately? And why would Tyson say Easton was injured during the bath? I guess I don't see how the baby's injuries could've been caused by his parents.

    I wasn't there that night, but the mother and her whole family have been friends of mine for years. Yes, the baby's father does have a history of violence, that's not a secret. But Heather had made choices to get away from him. She became a mother and decided to stop taking the abuse. The biggest part of that, I got the feeling, was for her son. She continued to have contact with him because they share a baby. If the baby had had HAIR RIPPED FROM HIS SCALP during a fight between dad and mom, wouldn't that have been the first thing the babysitter told the police about? Not a bullshit story about a bath? I know abuse can be very hard to uncover from parents, but this baby spent a lot of time with all of mine and Heather's friends, they are competent, caring, trustworthy women, who would not have hesitsted to call the police themselves if they had even SUSPECTED abuse. There was nothing they saw that gave them that impression. I made it a point to never know the father, I can't comment on him. Heather loved and wanted her son. And he was an absolute light in everyone's life.

    Carol13, I know so many people must be grieving over the loss of this beautiful boy. And I'm with you--what we know right now doesn't give us any reason to look immediately at the parents. I mean, unless this is some kind of conspiracy or the cops are completely incompetent, it would be the people who were last with the baby who would be the main suspects.

    tyson passed a lie detector test, check out the father, he was in jail for abuse. head injuries build up pressure leading to nausea and coma over time, hours or days sometimes. the parents were together and fighting before they needed a babysitter. Maybe they didn't know how severe the baby was hurt. Maybe the hair was pulled out while being yanked out of the bath water. Do you know what adult cpr can do to a baby when you don't know there is a different kind of cpr for a baby? I don't think most people are stupid enough to say he drown when it can be so easily disproved. I really doubt Easton's mother knew how bad he was hurt, if she knew at all. Check out the dad. Who knows, maybe the baby simply fell while they were fighting and they didn't even notice because of their own fight. I don't think the babysitter killed this baby.

    carol if u are so close to the family,why dont u know child services were out checking out the parents for robert blowing pot smoke in the babys face,not mention the mother claiming she almost lost the baby while she was pregant from robert. if u read up on head injuries on infants it can take hours for any bruising to show.what about the bloody fight between the parents,wiping the blood hands on eastons cloths(the police have)Robert is sick and the truth will come out! why has robert called a close relative claiming he knows tyson didnt do that? you may not really know how sick robert is?

    JHJ3, perhaps bruises can take time to appear on the head, but the baby also had blunt force trauma to the abdomen, leading to damage to his colon. I'm doubtful that kind of damage would take "hours" to reveal itself. Also, Tyson and Chalice are not very good babysitters if they did not notice that the baby's hair had been ripped from his scalp. I just don't understand how, based on the evidence, we can say Tyson is blameless.

    JHJ3 can you read? I don't know Robert. I chose not to know him. I know what happened while Heather was pregnant. I don't think Heather did this, I think the babysitter looks damn guilty. Let me say it one more time, I don't know the father. I made it clear I knew the father was abusive to the mother. That is all I know of him.
