		<description>I was in the courtroom today when Casey Thierrault was sentenced.   He was the one that threw the first punch, but did not take any part in what happened after that.  He pled guilty to assault with intent to do great bodily harm less than murder.  He was sentenced to 6 months in jail and 2 years probation.  The judge made it pretty clear that he was the least responsible for Jono&#039;s death and that his co-defendants who actually caused the injuries resulting in the death would not be so lucky.   Judge Yates said that if he at all thought that Casey&#039;s punch caused Jono&#039;s death, he would not be receiving the sentence he did.  For Casey&#039;s part in the event, I think it was a fair sentence.  Yes, punching someone is wrong and what happened afterwards by Casey&#039;s friends was absolutely horrendous, but someone should not go to prison for punching someone in the face.  He is not responsible for what his friends did, they will pay their own price for that.

From what the judge said today I predict that the rest of the defendants will be doing prison, not jail, time and for what they did, that is probably what is best for society.</description>

The kids mom is obviously a saint.  However, it was 6-9 on 1 and the wannabe gangstas didn&#039;t stop when he went down.  I think it&#039;s best from a public policy standpoint to come down extremely hard on this type of behavior.

Not doing so sends out the message that 6 on 1 fights and head-stomping are simply &quot;horseplay.&quot;  Idiots like these kids, their families, and those who think like them need to realize &quot;horseplay&quot; does not involve stomping on a persons head........EVER.

		<description>To clear up earlier questions about why the teenagers were in the bar: the Margarita Grill had &quot;wall to wall wednesdays&quot; that was hosted by the local rap/hip hop radio station aimed at the 18+ crowd.  In Michigan you have to be 21 to drink but certain bars will allow minors into the establishment.  This particular bar had a history of people getting in trouble for underaged drinking either before going or while in the bar.  However, there was no evidence that any of the defendants were drinking.

As to the inquiry about whether the bar would suffer consequences...they are no longer in business.

I graduated with Jono and have met his mother.  She really honestly does hope these boys do something productive with their life.  They did not intend to kill Jono, but they took things too far.  It really was an accident.  An accident that should not have happened, but like she said, nothing can bring Jono back.  I hope they get some jail time and learn their lesson, but as a law school student, I do not believe they deserve to spend the rest of their life in prison.

And FTI, the trial for Eric Freeman begins Monday January 5, 2009 if you want to follow it.</description>

Hopefully these boys will become better people ... scare the living shit of them. I doubt she felt this way in the beginning, makes ya wonder if that is the reason for the drawn out time line of the court system.

The judge issued the eight-page ruling after Grand Rapids District Judge Michael Christensen said second-degree murder charges should be reduced against Simonson, Lopez and Therriault.
