From Jock To Prison Bitch In One Easy Beating

January 31, 2008 at 12:58 pm by

Casey Thierrault, Eric Freeman, and Ryan Simonsen

Grand Rapids, MI – Testosterone overload is never a pretty thing, but it got really ugly on the night of January 10. John “Jono” Krystiniak, 21, got pummeled in a six-on-one bar fight that left Krystiniak fatally injured and three former high school jocks in a position to learn what the words “prison bitch” really mean. Krystiniak was pronounced dead on January 23 after life support measures were withdrawn.

Casey Therriault, Eric Freeman and Ryan Simonson are charged with second-degree murder and manslaughter. Two other suspects, Javier Santiago-Lopez and Milton Billibaldo Lopez , are in custody awaiting arraignment. Luis Alfredo Gaston, the sixth beatdown artist, has not yet been arrested. All the suspects are either 18 or 19 years old, and at least three of them are former Wyoming Park High School jocks who graduated in 2007.

Casey Richard Therriault, 18, of Wyoming, was a football star for Wyoming Park who even had an article written in 2006 praising his moral fiber. Last semester he was a back-up quarterback for the College of the Sequoias, a community college in Visalia, California. Ryan James Simonson, 18, of Jenison, was a two-time state wrestling meet qualifier for Wyoming Park. And Eric Tyler Freeman, 19, of Wyoming, was a former fullback and linebacker at the school. All that Wyoming Park athletic training apparently didn’t come with How To Rein In Your Aggro lessons.

Krystiniak, 21, was also at football player and wrestler in high school and an honorable mention all-conference football player at Ottawa University in Kansas. Which is probably why it took six other guys to beat him down – he wasn’t gonna go in a one on one fight. Six to nine people attacked Krystiniak after he left the Margarita Grill on January 10. Police said the victim and others had an “exchange” inside the bar.

“It’s not like they knew each other,” Police Lt . Paul Warwick said. “There was an exchange between our victim and the others. Some of them met back up outside … and our victim was knocked to the ground.”

Some family members essentially called Krystiniak’s death horseplay that got out of hand. “They’re good kids, as I’m sure the other (suspects) are too,” said Harland Hampton, the step-father of Eric Freeman. “When teenagers get riled up they do silly things, and it’s unfortunate that something like this happened. But it has happened and they have to deal with it.”

The jocks’ families say that their three boys were good boys who didn’t know the three guys who have yet to be charged. Which is why two random groups from the same high school decided to pound on the same guy on the same night, I’ve no doubt.

Update:

Here are the other two

Milton Lopez and Javier Santiago-DeJesus

Javier Santiago-DeJesus and Milton Billibaldo Lopez were arraigned on second-degree murder and manslaughter charges related to the January 10 beating outside the Margarita Grille that eventually took the life of Krystiniak.

One other suspect, Luis Alfredo Gaston, has yet to be officially charged.

These jock types have learned this behavior of doing whatever the hell they want and getting away with it. Probably for years.- All thru school, and You read how the parents still refer to them as “good kids”?

“When teenagers get riled up they do silly things, and it’s unfortunate that something like this happened. ”

Yeah, if “teens” = legal adult and “silly” – murder.

Hmmm, I wonder where these asshats get there lack of personal responsibility from.

I hate jocks, I see the jocks from my school every time I go home to visit my family. Aging, guts hanging over their belts with their haggard looking former cheerleader wives and sense of entitlement just because they were semi-ok at playing a sport. Most of them are cops now. I guess you got to get that “I’m better than you” feeling from somewhere?

I was thinking the same thing – in alot of places – you can be IN a bar at 18 but you may not drink alcohol. They were certainly not old enough to be served. I wonder, if the bar will get any type of backlash? serving under age, contributing to, fines, lose their liquor license?

Some family members essentially called Krystiniak’s death horseplay that got out of hand. “They’re good kids, as I’m sure the other (suspects) are too,” said Harland Hampton, the step-father of Eric Freeman. “When teenagers get riled up they do silly things, and it’s unfortunate that something like this happened. But it has happened and they have to deal with it.”

Horseplay? Beating someone to death is far beyond horseplay.

I wonder if they play football in prison…

John the person who was killed in this incident was my fathers friends son. I did not know him personally, but I know his family had nothing but glory for the kid. He had his life together and so many professinals were looking at taking him on their teams. Her hospital bills were outrageous and the Detroit Red Wings have been helping pay for them.

    It’s such a sad , sad story.

At least jack-offs like this give me plenty of job security.

it says there were charges. he never was convicted and sent to jail for anything.

Well, not yet. Apparently the case is still in pre-trial.

From the June 23 article, here http://blog.mlive.com/grpress/2008/06/seconddegree_murder_charges_re.html :

Ryan Simonson, 18, and Milton Billibaldo Lopez, 18, who previously were ordered to stand trial charged with assault with intent to commit great-bodily harm less than death, a 10-year felony, now will stand trial for second-degree murder, a potential life offense, Kent County Circuit Judge Christopher Yates said in a written opinion.

He let stand a 15-year manslaughter charge against Casey Therriault, 18. He also rejected a defense challenge to a second-degree murder charge against Eric Freeman, 19. Luis Alfredo Gaston, 18, also is charged with second-degree murder.

The judge issued the eight-page ruling after Grand Rapids District Judge Michael Christensen said second-degree murder charges should be reduced against Simonson, Lopez and Therriault.

While the suspects allegedly played different roles in the early-morning attack, prosecutors contended all should stand trial for second-degree murder under an “aiding and abetting” theory.

You stated that the charges were “droped”. I was just showing that in the case of Milton, they were not.

Former College of the Sequoias quarterback Casey Therriault pleaded guilty to involuntary manslaughter in the Jan. 10 death of Jonathan Krystiniak, 21, Monday in a Grand Rapids, Mich. courtroom.

Therriault, a Michigan native who was COS’s backup quarterback in 2007, was charged with second-degree murder for his role in Krystiniak’s death outside of a restaurant in Grand Rapids.

“Our thoughts go out to the family of the victim and to Casey and his family,” athletic director Lamel Harris said in a press release. “This was a very sad incident.”

Luis Gaston, who was also being charged with second-degree murder for his role in the incident, also pleaded guilty to involuntary manslaughter.

Both are scheduled to be sentenced Dec. 2.

According to the Grand Rapids Press, Therriault faces a minimum sentence of zero to 17 months in prison based on the terms of the plea agreement.

“I believe these boys deserve a second chance,” Krystiniak’s mother, Susan Stariha, told the Grand Rapids Press. “Nothing is going to bring him back.”

Stariha also added that she did not want to see the young men go to prison for a long time and that she hopes they do something with their lives.

Therriault played in seven games for COS in 2007. He threw for 235 yards and three touchdowns.

0 – 17 mos min. – is that the recommendation or a plea deal ? That is a pretty wonderful thing for the mother of the victim to put out there. It is very true what she is saying.
Hopefully these boys will become better people … scare the living shit of them. I doubt she felt this way in the beginning, makes ya wonder if that is the reason for the drawn out time line of the court system.

To clear up earlier questions about why the teenagers were in the bar: the Margarita Grill had “wall to wall wednesdays” that was hosted by the local rap/hip hop radio station aimed at the 18+ crowd. In Michigan you have to be 21 to drink but certain bars will allow minors into the establishment. This particular bar had a history of people getting in trouble for underaged drinking either before going or while in the bar. However, there was no evidence that any of the defendants were drinking.

As to the inquiry about whether the bar would suffer consequences…they are no longer in business.

I graduated with Jono and have met his mother. She really honestly does hope these boys do something productive with their life. They did not intend to kill Jono, but they took things too far. It really was an accident. An accident that should not have happened, but like she said, nothing can bring Jono back. I hope they get some jail time and learn their lesson, but as a law school student, I do not believe they deserve to spend the rest of their life in prison.

And FTI, the trial for Eric Freeman begins Monday January 5, 2009 if you want to follow it.

    supersniffles,

The kids mom is obviously a saint. However, it was 6-9 on 1 and the wannabe gangstas didn’t stop when he went down. I think it’s best from a public policy standpoint to come down extremely hard on this type of behavior.

Not doing so sends out the message that 6 on 1 fights and head-stomping are simply “horseplay.” Idiots like these kids, their families, and those who think like them need to realize “horseplay” does not involve stomping on a persons head……..EVER.

I would love to ask these idiots just how “gansta” they felt that night. Honestly, six to nine girls would be able to easily beat a drunk guy to death. Simple fact is they were not tough, they were absolute cowards who knew none of them had a chance one on one.

Unfortunately, I’m not in charge of this matter and it looks like some of these kids will get off with light sentences. Looks like your view prevailed supersniffles. I’ll be keeping an eye out to see if one of these kids turn their lives around and makes up for Jono’s death or simply makes the world a little better than it is now. My prediction is they’re idiots that are utterly incapable of amounting to squat. Anyone wanna bet?

    One last thing,

Anyone that think these “kids” just got a little out of hand and deserve a second chance need to ask themselves the question below:

    Would I rather:

    A) Allow someone to shoot me in the head with .22 pistol at ten paces; or
    B) Have six grown men kick, stomp, and jump on my head

Yep, pretty much a coin toss but I would have to lean towards A. Again, this was not “horsepaly,” getting out of hand, an accident, or fooling around. It was murder.

I was in the courtroom today when Casey Thierrault was sentenced. He was the one that threw the first punch, but did not take any part in what happened after that. He pled guilty to assault with intent to do great bodily harm less than murder. He was sentenced to 6 months in jail and 2 years probation. The judge made it pretty clear that he was the least responsible for Jono’s death and that his co-defendants who actually caused the injuries resulting in the death would not be so lucky. Judge Yates said that if he at all thought that Casey’s punch caused Jono’s death, he would not be receiving the sentence he did. For Casey’s part in the event, I think it was a fair sentence. Yes, punching someone is wrong and what happened afterwards by Casey’s friends was absolutely horrendous, but someone should not go to prison for punching someone in the face. He is not responsible for what his friends did, they will pay their own price for that.

From what the judge said today I predict that the rest of the defendants will be doing prison, not jail, time and for what they did, that is probably what is best for society.
