Jan 5, 2008 at 2:14 am -I agree that the blame for this accident belongs to Michael Gagnon. However, from a legal standpoint, it’s unlikely that your argument is gonna wash on liability unless it can be proven that only Michael ever drove that truck. The name on the title, apparently, is Sam’s - not the company’s. So there may well be some legal responsibility on Sam here, just as there is likely to be liability on the part of the bar that continued to serve him.
My initial kneejerk reaction to what I still consider to be a pretty lame apology is somewhat tempered by the hope that Sam’s original quotes were taken out of context (although i have no facts to base that hope on, only other posters hoping that’s the case as well.) The fact remains that Michael killed this family, not Sam. I think everyone here realizes that and has sympathy for the Gagnon family.
But two-thirds of the Gagnon family aren’t dead. In pain, yes, of course, and for that we are all sympathetic. But not dead. And Michael Gagnon is not a child whose life has been snuffed out through no fault of his own. So my sympathies in this case really do lie more with the actual victims here - those who lost their lives, and those who weren’t out partying it up with Michael that night and who had no ability to keep a drunk man away from his keys. If that makes me a harsh bitch, well, in this case i’m willing to bear that label gladly.

The bar was open for business - our family had a section reserved for the Christmas party.
The keys issue - I know the answer to that question but cannot answer until the case is resolved. I am hoping that there will be a quick resolution without a trial to spare the victim’s family any additional pain & suffering.
Sympathy for the Gagnons - refer to my first posting. The Gagnon family is not asking for any, and asks that the focus remain with the Griffins & Burkmans. If I have inadvertantly given that impression, I apologize.
Civil Liability - Michael can be held liable (obviously), Sam also as the truck owner. and possibly the bar. Maybe the server?
Drugs found in the bar - How stupid can one be to have that stuff (HGH) in the bar, knowing that the bar will be under intense scrutiny???
Morbid you were right as far as the civility on this site. Thank you all.

I have a friend that has lousy credit his car and motorcycle is in his brothers name.
* the fact that sam is younger could be his credit is in better shape and Michael was making the payments on it. mutual agreement. my guess.

Jan 5, 2008 at 6:56 am -Thanks ImpQueen for your sympathy - having lost 2 lives, knowing they have surviving children and to see the pain its caused their parents and siblings hurts so very much. has been 2 weeks + 3hrs now and I know her father is still not returned to work and has not been sleeping or eating - cries all the time. But he too has said that he forgives the drunk driver. (He too has been known to drink and drive in the past) I myself can not say that I do and don’t truely understand how he can except that it is his faith in God. The problem I have is that its been publicised over and over that it is ilegal and in that case a man 40 yrs old should know better.

A bit confusing. I like the order you had before because you could always look for the post number to find out where you left off. Otherwise, great site, found it after the tragic Gagnon case. As for I live in the town of Adrian and have meet the Gagnon family and have been following it closely.

To especially the Griffin and Burkman family, but to also all of the readers of this article:
As a writer who comes from a close and once happy family, we all would like to express our remorse and the absolute concern for the tragedy that has happened.
Everyone that reads this article knows that we all have been placed in opportunities of making sound decisions or have somehow failed the improper ones. A tragedy such as this one shows how fast life can change, or in all situations, turn around unexpectedly.
The sudden and devastating loss of such innocent lives, those that did not have the chance to make much of an impact upon those outside of the immediate family, is a loss of unbearable tolerance. And for this, we are all truly at a standstill to you how we feel right now.
The loss of these five people, who have been important assets in the lives of many, was something to us that is unimaginable. Although our thoughts and prayers will always be with our son and brother, please understand that my dearest sympathies, thoughts, and prayers, and undivided attention extends to all family members, friends, and individuals that have been touched by this tragic situation.
Our brother cannot apologize in person to everyone that has been affected, but we promise that we will do that for him. My mother, father and the rest of my family want you all to know that the Griffins and the Burkmans will always be in our continued prayers and thoughts.
I pray that God will be there to guide each and every one of us as the days bring about new challenges to overcome. May the words of my mouth and the meditation upon each of our hearts be acceptable in your sight.

Just wanted to thank everyone for their support. We are coping as well as expected. Beau is doing very well. My heart goes out to everyone. Especially the little ones. I will get Beau by the school when he is ready to say say hi to all his friends. I understand some won’t believe he is alive until they see him. Brett and I got to see Beth, Haley, Lacie and Vadie last night. We got to hug them, kiss them and say our goodbyes. We were able to make their final arrangement. Dan and Sydney are doing good. Sydney is walking around and should make a full recovery. Dan is the strongest man I know and my heart goes out to him. Again I want to thank everyone for their support. I better get some sleep, we drove back from Ohio last night and just walked in the door. I had to let everyone know how Beau was doing.
Also, Micheal Gagnon’s mom spoke to reporters about how remorseful he is in this news-story:

I went to the church service this morning for the family. It was beautiful. Most of the immediate family were able to come. Beau did pretty well. He broke down at one point, but he had a lot of support of course. Danny was there and looking very well physically. He still must wear the metal ‘halo’ for his spine injury for many more weeks though. We all hugged him and Jack very tight. Jack, Dan and myself all wore our BLUE of course.
Afterwards I took my Godson Beau and Jack’s fiancee’s son, along with my 11year old son to my cousin’s house (she also has a son that is 7). The boys all played football and playstation, Beau had a blast and was smiling. It was great to see! Meanwhile Jack was able to get some well deserved and needed sleep while we were gone.
Tomorrow my husband and I plan on making some food and taking it to Dan’s hotel to help them with food expenses. For Tuesday, I’m sure everyone has read in the paper that the gathering after the memorial service will be at the American Legion in Towson. Directions will be given at the church service. Thanks to everyone for their constant support. Bethany would have been ‘humbled’ by the support and outreach from all over the country.

One More weekend
of craziness with the Michigan house from hell and then it’s over…finally.
The estate sale is this weekend and I for one will be glad to be done with that house. It has been a pain in the ass and taken up so much of our time and energy. A stick of dynamite would have done the trick too.
The 8 hour drive from Baltimore to Michigan takes its toll especially on a preggo who has a bladder that doesn’t hold much anymore. Oh and have I mentioned how boring the three hour drive through Ohi-er on the turnpike is?
I am already in my 6 month of pregnancy and Dan and I were just saying how we have not had time to just breathe and enjoy me being pregnant or enjoy the summer.
On a good note…with all the trips to Michigan, I have been getting my fix of loose hamburgers (which I can’t get here).
Hey for every cloud man…ya gotta find something.

Time is flying
Like it always seems to do for me while I am pregnant. I am not like most women who feel like time stands still and they will be pregnant f-o-r-e-v-e-r!
I am already in my 16th week…close to halfway finished baking this little tater tot. I swear I feel like Danny and I just decided to start trying for this baby and here I am already.
It’s nice to be over the first trimester hump and past the time when I feel exhausted all the time. Taking a nap everyday just isn’t always plausible when you have 6 kids and 2 beasts to care for. Not to mention working, school and homework.
So, now I am just enjoying being pregnant and the amazing wonderful time it is. Speaking of which, the little one has been poking at me lately. I never get tired of that feeling.

That is a long trip, does anyone know did Dan have custody of his girls - I had wondered if they were intending on taking the girls back to michigan after new years for school. Or was it they were bring them home from visiting jody for the holidays. Who is she referring to as the 2 beast ?

It also says he hunts deer with a bow and arrow, and has antlers up in his home. I’m sorry, I know a lot of people hunt and see no problem with it, but I am not fond of people who hunt down innocent animals.

Jan 7, 2008 at 10:06 am -Wonder, if you read all the links in the order that they are provided (like any new members are likely to do) you will see that they were picking up the two girls in Michigan for a visit from their mothers house where they LIVED AND WENT TO SCHOOL. So, from this one could assume that he did not have custody of the girls.
How this is relevant to the case, I don’t know. I think imp is simply pointing out he fact that many of your posts are redundant and go off on unrelated tangents with outrageous speculations that mostly confuse instead of clarify.
Please read, comprehend and THEN comment.

Jan 7, 2008 at 10:15 am -i been reading this since the beginning and I have hit the links and I have went to other pages outside of this site but i do miss things, we are not all perfect or english majors - you can not trust what the papers write you can not read between the lines. but in my state may when bethany wrote that she was caring for 6 children during the school year. so it is confusing i was just verifing who has custody. why would they be traveling on a sunday back to maryland with kids possibly with tons of christmas gift unwrapped. most school start back after new years … so that is another reason i thought maybe the custody is with the dad.

I don’t have time to read all the links and boards and posts, so appreciate it when someone picks out something that they feel is of special significance and posts it.
Having lost many loved ones when I was a child, it is good to hear that the little boy is smiling some and surrounded by people who care. It’s so hard when one is a child to deal with death.
On a lighter note — does anyone know what “loose hamburgers” are? Sounds like you have to stab them with a fork as they run around the dining table.

Getting you in a bad mood wasn’t really my intention - after all, I did say that i might just be touchy today. And apparently I was. Somehow posting Bethany’s blog messages in their entirety seemed intrusive to me, although I can see how it might not feel that way to others, or even to me at a different time. I was cranky, I apologize.
A couple of times it’s seemed like maybe you were trying to find negative things about this dead woman (asking who the “beasts” were without really reading, for example), and that rubbed me the wrong way, and I was more abrupt than I should have been.
In answer to your custody question: I dunno who had custody of Danny’s kids. Most of them are dead now, so to me it’s kind of a moot question. Does it matter? If so, I’ll try to find an answer for you.
Again, my apologies. I’ll really try not to be a bitch, and if I don’t feel that I can answer without sarcasm, I’ll try not to answer you at all.

It truthfully made me cry, because yes, it seems you are so concerned with the details of these folks lives and I wonder why? They’re dead, killed one horrific night by an inconsiderate drunk driver. What child belonged to who, or lived with whomever….you get my drift…doesn’t seem to really matter. Most of the children are dead. Reading how Bethany felt on the trips back and forth, what does that matter? Really?
I guess that statement right there, It felt so god damn odd. Why in the world are you curious as to these things?

No one is sure how they are funded, but they go from one high-publicity funeral to another and spread hate about homosexuals. Their logic in our case was, “God hates homosexuals. Thirteen miners died. Clearly God did this because the state they live in doesn’t persecute homosexuals.”

In the second instance in less than two weeks, an apparently intoxicated driver was involved in an injury accident going the wrong way on a Toledo interstate early Friday, authorities said.
Tiffany Dewey, 20, of 5210 Spicer Rd., was arrested at 2:20 a.m. shortly after the vehicle she was driving west in the eastbound lanes of I-475 at Rushland Avenue near the Monroe Street entrance ramp collided with a pickup truck, injuring its driver, Toledo police said.
Ms. Dewey was charged with driving while intoxicated and cited for reckless operation and driving the wrong way on a one-way street.
