Well, he is about to get reamed. He was in court today and was assigned a public defender because he stated he did not have enough money for an attorney. Toledo Municipal Court Judge Michael Goulding then set bond at $1.25 million.

Let us all take this time to say a prayer for Michael’s brother, Samuel. After all, he may not have lost 5 family members, but instead of partying, he has to look forward to his brother going to jail.

    *tears up*

I’m sorry *sob* I got something in my eye.

I was wondering if anyone noticed that Michael and the owner’s of the bar were related….I believe I read where they were cousins. I was thinking, if it were a family function, then no one probably gave a shit at the bar, just how much Michael was drinking.

As far as the drinking/smoking pot thing. Been there done both. I’d much rather be in a room full of potheads than a room full of drunks. Any fucking day.

We have not seen his Myspace page, or know if he has one. The original Myspace link and picture were not the right Michael. We got those links from someone else before his mugshot was released. It was just coincidental that another Michael around the same age also frequented that same bar.

I don’t do this very often, but here goes…

*Ahem*, dear God, please allow Samuel Gagnon the strength and energy to maintain a second job so that he can keep his murdering piece of shit brother fully stocked in Astroglide. Please allow him to live with the fact that because he probably allowed his brother the keys to his truck that Michael, his baby killing brother, will now spend the rest of his life holding onto the belt loop of some donkey-dicked inmate who will loan him out to his friends for some anal love on a regular basis. Please take away his brother’s gag reflex so that he can spend his life doing something useful and productive for once in his life.

    Ahhhhhh-men.

Yeah, looks like it. And on Rodeo whatever’s page, he is listed as one of their top friends out of over 1000 people. Beer bottle in his hand, how fitting.

The Rodeo shit took down the little magnet that they had saying RIP or whatever. They basically took the same magnet thing that someone used to post the “don’t serve…” message, and turned it into some generic RIP shit that they didnt even take the time to mention all the victims’ names. And I made sure that it was them that posted it, because it wasnt in the Comments section. Now they took it down. I think they are really worried about their role in this

That’s the brother, for sure. The person who originally emailed me probably deduced that the Michael guy was his brother, especially since he uses the word “bro” in one of his comments. A term that can be used to describe a brother, and of course, a friend.

Don’t you love those comments? Sam G. needs to put a link on his page to the paypal account for donations for the victim’ funeral expenses. That’s how his hard partying friends can help. They can help pay to bury that family. One unexpected death can lead to financial hardship, but 5? Self-absorbed asswipes.

What a bunch of losers. I can understand going to a party and having a couple drinks now and then, or having a glass of wine in your house, but unfortunately many people do not know how to drink responsibly. And they think it’s funny and cute, by the looks of all these Myspace pages. When you are holding an alcoholic beverage in almost every picture on your profile, you may want to rethink your priorities a bit. And this whole college boozing trend needs to end now. It should not be tolerated or glorified at any university or college.

One paper quoted him today as saying his brother made a mistake and must face the consequences. That justice must be served. Nice 180 on your brother, Sam! eyewitness account from a reporter:

In the middle of the road, just before the overpass, there was a child seat. Upright. Empty. This was bad.

I went into photog autopilot, shooting all the video I could. Firefighters were working to pull one child from the van, there was already what looked like one covered body already in the middle of the road, but with all of the other debris, it was hard to tell if it was just a pile of blankets.

Another little girl in pajamas was right next to the passenger’s side of the van. One firefighter was giving CPR. It was bad. They eventually put her on a stretcher and loaded her up into a life squad, but moments later pulled her back out and put her back on the ground and covered her up. Apparently needed the squad for a critical patient they could treat, and they did the best they could for her.

Cromer, the photographer I pulled up behind, and I just kept looking at each other. I followed him so we’d both be in the same place in case we got pushed back. That, and he’s a great spot news shooter who knows where to be and when. I consider myself pretty good, but I’ve got more to learn.

He told me that right before I walked down, he saw a firefighter sprinting to a life squad with an infant in his arms. When I called my dad after getting back to the station, he said the report on the scanner said it was a 6 month old. (Update: 2:50, we just confirmed with TPD that this infant did not survive.)

As we began moving around the scene, getting different angles, we began to notice just how bad it was. First of all, we couldn’t tell what kind of van it was which, for us, is saying something. We saw the debris thrown from the vehicle; not just auto parts, but mostly presents, holiday cards, clothing and luggage. Police told us it was probably a family from Maryland, according to the plates, presumably traveling for the holidays.

Another realization we found as we moved to the other side of the scene was how many people had been killed. We saw two more bodies than we had already known, and we continued to make eye contact with each other. This was really, really bad.

We get an interview with a sergeant a little later on, where he tells us what we expected to hear based on what we had seen at the scene: they think a drunk driver caused the head-on crash by driving the wrong way down the interstate. 6-7 people in the van, 1 person in the pick-up. Witnesses said the driver in the pick-up was complaining about his job right after the accident as he was pinned in the vehicle, apparently oblivious to what had just occurred.

To especially the Griffin and Burkman family, but to also all of the readers of this article:

As a writer who comes from a close and once happy family, I want to express to you our remorse and the absolute concern for the actions and unbearable decision that my brother has made. Everyone that reads this article knows that we have all been placed in opportunities of making sound decisions or have somehow failed the improper ones. My brother understands fully that the decision that he made the night of December 30th, 2007, impacted a family and famillies beyond belief. A tragedy such as this one shows how fast life can can change, or in all situations, turn around unexpectedly.
The sudden and devastating loss of such innocent lives, those that did not have the chance to make much of an impact upon those outside of the immediate family, is a loss of unbearable tolerance. And for this, I am truly at a standstill to tell you how I feel right now. The loss of these five people, who have been important assests in the lives of many, was something to me that is unimaginable.
Although my thoughts and prayers will always be with my brother, please understand that my dearest sympathies, thoughts, prayers, and undivided attention extends to all family members, friends, and individuals that have been touched by this tragic situation. My brother cannot apologize in person to everyone that has been affected, but I promise that I will do that for him. My mother, father, and the rest of my family want you all to know that the Griffins and the Burkman’s will always be in our continued prayers and thoughts.
I pray that God will be there to guide each and every one of us as the days bring about new challenges to overcome. May the words of my mouth and the meditation upon each of our hearts be acceptable in your sight.

    Our prayers and thoughts,

    Samuel Gagnon

My ex had a van and his g/f had 4 little ones and when he had our 2 I complained the van did not seat 8 people. Even if there was a third seat in the back it only seats 7.

Keep in mind that there were reportedly six children and two adults - so you put three kids in each back seat (these vans have three seats). That’s one seatbelt per child including the one holding in the carseat for the eight-week-old Vadie. Then the two adults were in the captain’s chairs in front. There’s still cargo space in the back. (No, I do not own this type of van, but my in-laws do.) And if the front seat was a bench seat, there’s room for nine. Over Christmas we managed to belt in eight people (all older children or adults) into my in-laws’ van with no problem other than that I had to sit by my mother in law.

So was your point that the family deserved to get mown down because their van may have been crowded after the holidays, or was there another point that I missed in there? No disrespect, but it kind of sounds like you’re blaming this family for the loss of its children and mother.

He’s been charged with aggravated vehicular homicide, which carries a sentence of up to either 15 or 17 years, I don’t remember which. Let’s assume it’s 15. He has been charged with 5 counts, so I believe that’s 75 years max. Add the fact that it’s come out this creep has had multiple license revocations for failure to provide insurance. I’m sure he’s getting the book thrown at him and doubt he will recieve anything but consecutive sentences, considering he was the cause of 5 of 7 deaths on Ohio highways over the holiday. Does anyone know if the license revocations and/or aggravated charge carry mandatory no parole? I don’t recall.

Sam left this message on Theresa’s page :

I wonder if anyone has suggested to Sam that he might show how sorry for the family he is by taking out a loan against his construction business and paying for the funerals. After all, the truck was registered to him.

I found this under the Ohio section…

(1)The defendant knowingly created a grave risk of death for one or more persons in addition to the victim of the offense

It’s from the listings of aggravating factors that make a defendant eligible for the death penalty. Does this mean that the prosecution can ask for the death penalty since he nearly hit several other people who called 911 and reported him??!!

In the last 10 days I have had a personnal experience identical to this, on Dec 22 2007 ~ I losted a love one killed by a drunk driver. My friend of 23 years lost his only daughter (21). I was there with them when her mother went into labor, I have known her all her life. Her Friend Matt (29) was also killed when a man (40) crossed the center line. He was carring a loaded gun and pot in his pocket.
    http://news.cincinnati.com/app.....7712240390
There has been a few articles some videos - not much coverage on the matter. Each of them had one child. infact Makenzie’s baby just had her first Christmas and Her mother is dead. :( Their death was instant they felt no pain. They were wearing seat belts and the drunk driver had no seat belt and was released from the hosp. on Christmas and brought to court Wed. in a wheelchair - not a scratch on his face.
    http://www.local12.com/mediace.....eoId=22588
    http://www.local12.com/mediace.....eoId=22561

There also was a call made by someone following the white van reporting they were driving drunk. The witness claims 911 was telling him to call the local 825 number. he told them he was on his cell phone and driving. He continued to tell them he was going north toward the highschool. He complains that they wanted to argure with him. he finally hung up when he heard the sirens. The accident happen right after, before he saw any police car.

I was shopping in and out that sat and sun and didnt see the news I recieved a phone call from the family I was distraught extremely numb in a daze. Between then and Christmas I was struggling nothing got accomplished. thur and friday i began to pull it together to make food platters and mail cards help the familys visit the crash site (where i met lot of the kids friends and the witness) Spent the evening until weee hours in the morning with Makenzie’s father. Sat. I transported the flowers back to Makenzie’s mothers house. This week we are accumulating the legal documents with new years its not been very productive. We have a long road ahead of us it seems.

Neighbors complain of lots of wrecks there the cross traffic does not stop. They finally put a yellow flashing light there. now I have to admit yellow means caution NOT STOP shouldnt it be red ?

well the attorney he has is a high price lawyer one my ex husband uses.

here is the video explaining his sentence. he will do 200 community service hours 2 yr probation and 2 yr lost of his drivers license and after he graduates in June he will do 30 days.

The family has forgave him. the court hearing ends with a hug session.

this was yesterday and maybe due to the case they have removed it video but I managed to find it with using the cache link

After reading what the reporter saw and Samuel’s posting I must say I got a little emotional. I can only put myself in Samuel’s place and empathize with how he and his family must feel and the guilt they share. At least he made an attempt to be straight up about it and that is good starting point especially for someone young (folks don’t seem to have balls anymore or know how to do the right thing). And I’m sure he feels very responsible, but I have been around sneaky drunks before and if they are determined to do something, i.e. get into a vehicle and drive, they are bound damn and determined to do it.

Hippie did you say you had a van like this ?

Yeah, I was wondering how the hell they all fit in there. I saw where Imp commented on this. My only thought briefly was, they must of been crammed in there like sardines….but as far as that aiding to the accident, that thought hadn’t crossed my mind in anyway.
Our van had the two back seats….able to hold 6 folks, three per seat. (8 total people). We traveled with our two kids so we took out the very back seat, for all our stuff we traveled with. I always thought we were so packed in, if we did wreck we’d be padded. If this van would of flipped or rolled instead of getting it’s whole fucking side sheared off, more folks would have probably survived. (now I don’t know that for sure….so please don’t quote me on the shit)
Another brief thought I had was the car seat. If it was sheared off in the accident, how would it be intact? I was wondering if the car seat was buckled in? It sounds like it bounced out????
When we hit an electrical pole and flipped our car (not the van…we totaled the car in the accident) three times, it landed upside down, and my daughter was hanging upside down in the car seat. Still attached, still buckled in. I was never so glad to hear my kid scream.
Again, none of this takes away the fact this ignorant ass drunk killed this family.

The force of the impact was so great, the mother, Bethany was thrown out of the vehicle. Still in her seat. It’s no surprise the baby seat was in the road.

The car seat was found in the van and set in the lane by emergency personnel.

Did this Sam asshat get a Baptist minister to write that message for him? ‘Cause i’m guessing he doesn’t quote scripture from memory.

If I was God, I’d strike this bastard dead for misusing my stuff like that.

Man, Imp, that’s harsh. SAM didn’t drive drunk and kill people. His brother did. We have no reason to believe that Sam did anything wrong at this point. I wouldn’t want to be held accountable for the actions of my siblings. Would you?

The fact that he publicly posted an apology shows that he’s got a little bit of compassion and backbone in my book. Why you getting all harsh on his ass?

It’s not like I love Sam and want to have his babies or anything, but I can’t see how he deserves any particular ire at this point. IF it’s determined that he GAVE his brother the keys, then yes. But no official report I’ve seen has implied that. Just because he owned the truck does not make this his fault.

Seems to me he’s trying. He loves his brother. His family is going to be torn apart by this, too. MICHAEL is an unforgivable scumbucket. And clearly Sam understands just how fucked up this was.

    Just sayin’….
