This spoiled rich teenage girl was driving around with her friends, high on marijuana, and she was rummaging around for her cell phone while driving. Her parents were going out of town to Europe or something, and she wanted to make sure they didn’t leave before she got home, because she was going to hit them up for money. Anyway, she ended up crashing into a tree. Oh, and a teenage girl happened to be rollerblading in front of the tree, and the car pinned her to the tree and kill her.

“Worried, Samuel Gagnon said that he called his brother’s cell phone. He said his brother answered and simply said, “Sorry, bro.” Later, a Fire Department official got on the phone and said his brother had been in an accident. Samuel Gagnon said that his brother had been planning to travel to Iowa a couple of days earlier to begin a construction job but that he had delayed his trip for unknown reasons. “I wish he had just left,” he said.”

This drunk driver is a douchebag and deserves the full swing of the arm of the law and swiftly. The drunk driver’s family doesn’t seem to really understand the gravity of the situation beyond their monster-brother-son facing a long time in prison. Good people, yeah whatever…

Of course, from the brother’s comments I’d wager if it weren’t for her little bun in the oven she would have been just as trashed as the rest of them.

i do think we need tougher DUI laws here. i used to live in England and if you are caught with your automobile keys on your person while drinking you are charged with a DUI. if you are caught sleeping in your car, drunk (even if it is to sleep it off) you are charged with a DUI When i first heard that i thought it was pretty harsh, but when things like this happen it just shows that maybe that is a good law to have.

is driving drunk a felony or misdemenor? Also, did the cops ask the taco bell employees to detain Gagnon? if they had it looks like they could have done a citizens arrest. But what cop would ask a teenager to stop a 24 y/o drunk from driving away when the drunk could harm the kid?

Jan 1, 2008 at 5:34 pm -I’ve read several site’s review of this tragedy, and the comments are full of people (myself included) trying to find someone to blame. Because, if we can blame someone, we can find a solution to prevent this from ever happening again. Same thing happened after the Virginia Tech shooting, when nobody could have foreseen that event.
Obviously, the cocksucking (soon, literally) drunk is directly to blame. But our world is sadly full of these idiots, and they tend to out-breed the rest of us. So, what can the few, sober people do to protect ourselves from the rest of the drunks? And it has to be politically and economically feasible.

Jan 1, 2008 at 5:39 pm -swivel, i dont know, it seems to me that everyone involved (except for the other drunks and the DD) did everything they could to prevent this tragedy from happening.
According to the news conference Gagnon did not have any prior DUIs. He had previous charges for possession but they were dropped. i doubt that this was the first time he drove drunk, it was just the first time he was caught.

The entire culture of these people surrounds that establishment and drinking. Pictures of them drinking, talking about drinking, making fun of being drunk, etc. It’s a cultural thing.
Personally, I could care less if these idiot want to drink themselves into a coma…besides, without drunk college chicks we wouldn’t have pictures like this from Dana, one of Michael’s friends:

Jan 1, 2008 at 6:43 pm -I have read that drunks come out best in a horrendous car wreck because they are so out of it that they don’t tense up in anticipation of the crash. So their bodies respond to what is happening in a floppy way and that protects them to an extent. The people who are aware and tense up in anticipation or after the first impact richochet around in the car in a rigid state and the physical shock is more severe and destructive.
I know this sounds ridiculous, but I’ve read it many times. One of the actions involved in “learning to fall” is to consciously relax the body although it is counterintuitive.
Just some evidence that God may protect fools, but Satan surely protects drunks!

They could have taken his jacket off him, I guess. I just figured since pic 1 is answering phone…it might be the POS taking call from his bro. I wouldn’t think the dad would even have beenable to stand up in the condition the news listed.

Jan 1, 2008 at 6:52 pm -If you watch the video, you’ll see that the pictures are correct. The police certainly are not going to let Michael walk around the wreck like the show in the video. Also, there is no injury under the lip of the guy with the phone, while you can see some type of bandaging under the lip of the guy on the stretcher.

I have a feeling some of these kids in the van were sleeping, or didnt see it coming. It does seem as if the drunk drivers always come out much less injured, but I dont really have an explanation for it.

Jan 1, 2008 at 7:47 pm -It’s true. Same advice as if you were to fall down a flight of stairs. Protect your head and go limp. It’s the same technique perfected by stuntmen. To tense up, or stiffen, simply has the shock of the fall or impact travel straight to the joints and bones where the most damage will be done. Falling limp ensures that the soft tissues of the body will deform and absorb most of the shock.
A drunk “rolls with the punches” for the most part.

And another thing that came to mind, is those commercials for Ford trucks where they say “Built Tough”. I mean, that’s great for the person inside it, but what about the poor sap who doesnt have a Ford truck? They have to die because that monstrous hunk of metal came their way? Shouldn’t they be built not only to protect those inside, but in way to prevent as much injury should it strike another car? I mean, that thing tore through that minivan like a fucking tornado.

Jan 2, 2008 at 11:08 am -This story really sucks, what an asshole. I worked on the volunteer fire department in Southwest Missouri and I can’t tell you how many times I saw things like this. I would ask myself why do these guys have to be driving one ton dually pickup trucks and driving drunk and they alway hit someone driving a small car or truck headon.
This guy is going to have a long time to think about what he has done, how could me not feel bad about doing this? I just don’t understand that, if it was me I would do myself in because there would be no way I could live with what I had done and the guy at Tacobell did all he could do, if you have ever tried to stop a drink it is not a easy thing to do, even if they would have blocked the driveway with a car so that he could not get out, he would have just driven over stuff to get out of there, when you are that drunk you don’t care about anything.
My prayers go out to that poor family, what a way to start the new year.

Jan 2, 2008 at 11:16 am -This is a really sad and tragic story. But the most tragic thing about this is the drunk guy actually won’t spend much time in prison. Morbid or someone may want to do some research on sentences for these types of cases which I believe will be labeled as “involuntary manslaughter”. He will most likely get bond and if he gets a good attorney may only get probation. I live in Georgia and have seen many cases similar, not as many deaths, but have seen no more than 3 years in prison and as little as 12 months probation. Hopefully the laws are different where this happened. But the family can sue him, his brother and the bar in civil court for wrongful deaths.

Of course there is. Socialist England uses their DUI legislation to leech just that much more money out of citizens. England is one country I do NOT want U.S. law modeled after.
For as long as drinking is legal and driving is legal, there will be drunk driving, no matter how draconian our laws.
A few things we CAN do without turning our legal system into an arbitrary monster:
- Make education accurate. We focus so heavily on drug use in our health classes in high school even though drinking is the more serious threat. The younger we get them, the more effective it will be.
- Make DUI legislation more sensible. Why throw them in jail for a few days, fine the bejesus out of them, and then let them keep their license? I’ll tell you why - the government makes more money that way. Instead, we should illustrate the fact that driving is a privilege. Revoke their license on a first offense. Maybe make them eligible for reinstatement after 5 years and rigorous classes and assessments. On the second offense, the license is gone permanently.
- Lastly, we should make DUIs resulting in accidents sentencing as harsh as the law can possibly justify. If you crash into a building or hurt or kill a person, you shouldn’t be able to simply pay your way or community service our of it. You should suffer the same type of punishment as someone who intentionally destroys property, assaults or murders someone. If you fuck up and cause damage, there should be an appropriate consequence, not the bullshit 3-5 they typically dole out for vehicular homicide these days.
We can keep making standard DUI sentencing harsher, but obviously, it doesn’t do much help. The level of severity necessary to actually deter these offenses is ridiculous and unlikely to ever happen(i.e. outlawing alcohol). Instead, we should pursue more reasonable, effective means of prevention.

Jan 2, 2008 at 12:16 pm -I agree with Athena in some ways - I think that drinking needs to be the main focus when they talk about drugs because it is more accessible - more homes have beer, wine and liquor - my neighbor and I used to sneak beer and cigarettes from our Mom’s when we were like 13. I wish they would legalize marijuana - I have never in 30 years of being around smokers seen anyone get into a fight or an accident after smoking. And at parties, I see more fights on alcohol and those that are smoking are like “whatever”. If my son came to me with a bag of weed or a bottle of liquor and said your choice Mom, which do you want me to do I would tell him NEITHER, and if he said but I’m gonna do one or the other I would knock the bottle out of his hand.

I have a brother, who was 20 at the time, and my mom would buy liquor for him and his friends and let them drink at the house. She thought it was all fun and games, saying that they were going to do it anyway, so she’d rather them do it there. I was so pissed at my mom. I told her that if they leave and get into an accident, she could get sued. Not only that, but it’s disrespectful to assume that the friends’ parents are ok with their 20 year olds drinking. Just because she lets my brother, I think it’s super disrespectful to the other parents for her to do that.
I have another brother who was 19 and my parents knew he drank and smoke weed, and treated it like a right of passage or something. I dont get them. Maybe after all the drug problems they saw me go through, they think drinking and smoking weed is lightweight or something.

After the mugshot came out, it was quite apparent he was not the same guy we had featured, plus I received numerous emails telling me that the guy we had pictured was not the same guy.
